fff.tiUTy <br /> ®way of°Mashpee <br /> N <br /> .16 Great deck load d%rth <br /> Maslzpee, Massachusetts 02649 <br /> Conservation Commission <br /> Executive Session 5/14/2020 ZOOM Meeting Minutes: 110 Popponesset Island Suit <br /> 5:20PM-5:45PM <br /> ATTENDEES: Andrew McManus (Conservation Agent), Brad Sweet (Chairman), Chad Smith <br /> (Vice Chairman), Dale McKay, Thomas O'Neill, Katelyn Cadoret(Assistant Conservation <br /> Agent), Greg Pagnini (Town of Mashpee Legal Representative) <br /> 5:20 Roll Call to Start Executive Session <br /> Greg Pagnini stated the purpose of this meeting is to outline what the Commission desires as an <br /> outcome for the case. The Commission agreed to a common goal of having the property returned <br /> to its original state. Chad suggested we set a date where we will start issuing daily fines if <br /> compliance is not reached. Greg had stated it would not be the best course of action at this time, <br /> and Andrew concurred. Fines can be used as leverage when negotiating terms; anything prior to <br /> that may not result in a desired outcome. <br /> Katelyn inquired if the playground was brought up as part of the original offer from the <br /> plaintiffs; Greg stated they did not bring up the playground specifically but would find out what <br /> their intentions were as far as keeping it. Their original offer consisted of the following: Remove <br /> 5 feet of lawn,restore the dunes and pay for the plantings, and will not disturb the area further. <br /> Andrew went over the potential goals of the Commission per last conservation: To allow the <br /> coastal bank area to remain as lawn, as it is not a sediment-source coastal bank, and to absorb the <br /> mitigation plantings required in that area into a coastal dune restoration planting plan. They <br /> would also be able to construct a raised walkway through the dune to access their beach, <br /> preventing further disturbance to the dune area. Katelyn suggested a poison ivy management <br /> plan be included in their dune restoration; Andrew stated it could be mentioned as a potential <br /> future filing if the problem arises again; it was one of the original concerns of the homeowners in <br /> the coastal dune area resulting in the loss of vegetation. <br /> Brad suggested the adjacent properties be surveyed. Andrew countered that if any violations <br /> brought to our attention nearby would be handled when and if the time is appropriate, although it <br /> has no bearing on 110 Popponesset Island's violation. <br /> Greg stated Andrew and him will speak again before the next Executive Session to confirm the <br /> specific conditions the Commission wants to see met as the overall outcome of the case. <br /> 5:45 Roll Call to Dismiss Executive Session <br />
