Health Agent which Includes proper size of the septic tank, 4' vents, permanent generator, and <br /> other requirements that the Health Agent deems necessary. Motion seconded by Brian <br /> Baumgaertel. Roll call vote: Veronica Warden(yes); Brian Baumgaertel(yes). VOTE: Unanimous <br /> (2-0) <br /> 4. Review of Nitrogen Aggregation Plan—15 The Hunt Circle. Mr. Harrington commented that a <br /> nitrogen aggregation plan is being requested for this property, which is located in New Seabury <br /> Highwood section. The open space area at the Childs River East subdivision is to be used as credit <br /> land for the undersized property to obtain the additional bedroom. In this case,2141 square feet <br /> of additional land are being utilized to obtain the 50,000 square feet required area for five <br /> bedrooms. The credit land survey plan and Grants of Title V Nitrogen Loading Restriction and <br /> Easement for the facility and credit land have been provided. The fee has been paid and the plans <br /> and documents have been reviewed, with no Issues encountered. The septic design plans have <br /> not yet been submitted. <br /> Raul Lizard!-Rivera, of Cape & Islands engineering, stated that the property currently has a four <br /> bedroom residence with a four bedroom septic system. The owners want to tear down the <br /> existing house and construct a new five bedroom home,but want to get approval of the nitrogen <br /> aggregation plan prior to moving forward with those construction plans. Board members agreed <br /> that everything looked in order. <br /> There being no further comments or discussion,Veronica Warden moved to approve the nitrogen <br /> aggregation plan for 15 The Hunt Circle with the condition that the draft Grants of Title V <br /> Restriction and Easement must be finalized and recorded at the Registry of Deeds, with an <br /> executed stamped copy provided to the Board of Health prior to issuance of the septic permit. <br /> Motion seconded by Brian Baumgaertel. Roll call vote: Veronica Warden(yes);Brian Baumgaertel <br /> (yes). VOTE: Unanimous(2-0) <br /> 5. Review of request for new Hotel/Motel Permit — 76-78 Simons Road. Mr. Harrington <br /> commented that during the sweep of short-term rentals, the addresses of a few Willowbend <br /> townhouses were noted. The Code Compliance Inspector, Joe Callahan, spoke to the <br /> management at Willowbend, who confirmed that they have 12 rooms available for rent on a <br /> nightly to weekly basis. The townhouses meet the definition of a motel where transient lodgers <br /> can stay and rent a room. Willowbend has submitted an application for a new Hotel/Motel <br /> Permit. <br /> Ms. Warden asked how.long Willowbend has been operating without a permit as a hotel/motel, <br /> and Mr. Harrington indicated that it had apparently been many years. He further stated that he <br /> was always under the impression that the townhouses in question were individually owned, and <br /> this is the first he learned that they are owned by Willowbend and being rented on a nightly and <br /> weekly basis. Ms. Warden asked if a fine was in order, for failure to seek a permit prior to this <br /> year. At a minimum,she felt that a representative from Willowbend should be invited to appear <br /> before the Board to explain why they have previously applied for the required permit. Mr. <br /> Harrington stated that, at this time, he did not have any direct evidence of how long they have <br /> been operating. He reminded the Board that there was a change in ownership,when Southworth <br /> bought out Willowbend a few of years ago. Ms.Warden suggested that a Health Agent reach out <br /> to the Building and Fire Departments to ensure all required permits were obtained for the <br /> townhouses. Chair Baumgaertel agreed that someone from Willowbend should account for why <br /> they have failed to be in compliance, and it was requested that Mr, Harrington further research <br /> this matter. <br /> 4 <br />
