Ms. Warden <br /> requested that a note be added to the plan that there were no drinking wells on the surrounding <br /> properties. <br /> There being no further comments or discussion, Ernest Virgilio moved to approve the variances <br /> at 15 Kim Path, provided all of the Health Agent's comments are addressed and pending the <br /> Health Agent's approval of the final plan. Motion seconded by Veronica Warden. Roll call vote: <br /> Ernest Virgilio(yes);Veronica Warden(yes). VOTE: Unanimous(2-0). <br /> Ernest Virgilio asked, in the case where a new system is being installed and the existing system <br /> cannot be located,how the old system is abandoned. Mr.Harrington answered that the dwelling <br /> is usually serviced by a cesspools in those cases, and a septic Inspection would be conducted. <br /> 2. Review and approval of Title 5 Variances — 16 Spoondrift Circle. Mr. Harrington commented <br /> that,at the last meeting,the Board requested that a benchmark and locus be added to the plan; <br /> a floor plan be provided;a vent for the Soil Absorption System(SAS) be added;and that the word <br /> "divergences" be changed to"variances"on the plan. Floor plans were submitted depicting three <br /> primary bedrooms,with doors leading to a den/study, and a screen porch with a fireplace on the <br /> first floor. The second floor shows there is an office with pocket doors that lead to two areas of <br /> unfinished storage. Mr. Harrington informed the Board that the property is in a Zone II, and is <br /> therefore restricted to the three existing primary bedrooms. The doors on the study make a <br /> fourth bedroom, and the office on the 2"1 floor makes a fifth bedroom, due to the pocket doors. <br /> Mr. Harrington could not tell from the floorplan if the porch was screened in or had hard walls, <br /> but it is a heated space due to the fireplace. <br /> Mr. Ryther asked if removing the doors on the den and office would bring the property into <br /> compliance. Ms. Warden answered that the den and office must have 6' cased openings, no <br /> doors. She explained that that would eliminate the privacy, so the rooms could remain finished <br /> and heated spaces, without meeting the definition of a bedroom. Mr. Harrington advised Mr. <br /> Ryther that the rooms labelled as storage must remain unfinished and unheated. Mr. Ryther <br /> Indicated that he would submit revised floorplans eliminating the privacy In the den and office. <br /> Mr. Harrington noted that the distance to the"dust slab" is requested to be reduced from 10'to <br /> 7'. He noted that the liner is worthy,as there should still be some mitigation for this variance. <br /> There being no further comments or discussion, Ernest Virgilio moved to approve the variances <br /> for 16 Spoondrift Way as stated on the plan dated October 13, 2020. Motion seconded by <br /> Veronica Warden. Roll call vote: Ernest Virgilio(yes);Veronica Warden(yes). VOTE: Unanimous <br /> (2-0). <br /> 3. Review and approval of Title 5 Variances—38 Quail Hollow. Mr. Harrington commented that,at <br /> the last meeting, the applicant withdrew the application to meet the Board's request for <br /> additional soil information in regard to the depth to pervious soil and the permitting path for the <br /> Busse system with the phosphorous removal unit. The designer prepared a cover letter explaining <br /> the permitting,and the revised plans show the soil test confirming the depth to pervious soil. <br /> Matt Costa, of Cape & island Engineering, introduced himself for the record as representing the <br /> applicant. He stated that,at the last meeting, Board members were asked to consider a variance <br /> for the 4' of naturally occurring material, with implementation of a phosphorous removal <br /> technology as mitigation. Phosphorous is the nutrient contaminant which causes an imbalance <br /> In the ecosystem and drives algae blooms In the pond. The Board was favorable to the concept <br /> 2 <br />
