It was understood that expense warrants would have to be signed <br /> outside of the meeting,due to there being no Board members physically present. <br /> 3. Review of Compliance—100 Great Neck Road North. Mr. Harrington commented that he had <br /> notified the property owner,Juan Marichal,that this matter was on this evening's agenda,and he <br /> thought Mr. Marichal was going to participate in the discussion. Mr. Harrington confirmed that <br /> Mr. Marichal had received the fine letter and,after indicating he wanted to discuss the fines with <br /> the Board, he was sent the Zoom invitation. <br /> Chair Baumgaertel asked Mr. Harrington if he had any indication where Mr. Marichal was at with <br /> the system design and engineering. Mr. Harrington answered that it had been submitted to DEP, <br /> but he did not know what the status was, or if anyone at DEP had looked at It. The design is for <br /> four proposed systems, with a series of septic tanks and pump chambers that pump to pressure <br /> distribution leach fields, but there is no advance treatment proposed on any of the four systems. <br /> Mr. Harrington stated that Mr. Marichal had owned the property since May of 2019. <br /> Mr. Marichal did provide the history of pumpings by Ready Rooter, which showed the septage <br /> haulers had been out to the property quite a bit between February and November 2020, but Mr. <br /> Harrington felt that there was not adequate monitoring of the systems in between pumpings. Ms. <br /> Warden asked why Mr. Harrington believed Mr. Marichal was not monitoring the systems, and <br /> Mr. Harrington answered that the three verified overflowing systems, the one by the office and <br /> the one by the laundry, would indicate that routine monitoring was not being performed. Chair <br /> Baumgaertel agreed that a closely monitored system would not have overflowed. <br /> Mr.Virgilio was of the opinion that It should be a requirement for Mr.Marichal to provide a record <br /> of monitoring to the Board on a regular basis. Chair Baumgaertel agreed that there was a <br /> dereliction of duty with respect to monitoring, and it was prudent to impose a stricter reporting <br /> requirement. <br /> The property owner,Juan Marichal,called in to the meeting at this point,and Chair Baumgaertel <br /> summarized the Board's discussion and position. Mr. Marichal stated that the systems are being <br /> monitored weekly, and Ready Rooter conducts pumping every two weeks. He stated that the <br /> cesspool by the office overflowed due to overcrowding in one of the units tied into that system. <br /> Mr. Marichal gave notice to the occupants that the units are limited to two people, and the <br /> process to relocate them to other units is already underway. <br /> Mr. Harrington stated that the system behind the laundry was overflowing badly on two <br /> occasions,and Mr. Marichal assured him that the systems by the laundry and the office are being <br /> checked frequently. He stated that they were doing everything in their power while they waited <br /> for DEP approval. Board members were in agreement that the systems that are having issues <br /> need to be monitored more closely, and Mr. Marichal stated that he would make certain the <br /> system behind the laundry was checked on a daily basis. <br /> 3 <br />
