Town of Mashpee <br /> �tw.a,....,ar•�, <br /> 04,/fin •�-\h�'�\`ry <br /> 16 Great Neck Road North <br /> �,;�, Go• Mashpee, Massachusetts 02649 <br /> BOARD OF HEALTH - PUBLIC SESSION <br /> Mashpee Town Hall— Popponesset Meeting Room <br /> Minutes of the Meeting of December 17, 2020 <br /> Board Members Present: Member Absent: Also Present: <br /> Brian Baumgaertel,Chair Glen Harrington, Health Agent <br /> Veronica Warden,Vice-Chair Caitlin Cantella,Assistant Health Agent <br /> Ernest Virgilio,Clerk <br /> Chair Brian Baumgaertel called the meeting to order at 7:08 PM, and stated for the record that all Board <br /> members were participating remotely. <br /> OLD BUSINESS <br /> 1. Review of Compliance—73 Lovell's Lane. Mr. Harrington stated that he had not had a chance to <br /> follow up on this matter,so there was nothing new to report. Ms.Warden felt strongly that some <br /> action should be taken with respect to the vehicles that had been on the property for 20+years. <br /> Mr. Harrington indicated that, during the last visit to the property, the current occupants had <br /> been advised to remove the vehicles. Ms.Warden asked if the trailer where the current occupants <br /> are residing is tied into the septic, and Mr. Harrington answered that he had not had an <br /> opportunity to get back to the property to determine that. Ms. Warden recommended that the <br /> Fire Department be contacted to schedule a check of the heating system in the trailer. She also <br /> inquired if the original dwelling had been inspected. Mr. Harrington responded again that he had <br /> not had an opportunity to return to the property, but he believed the house had been vacant for <br /> roughly 20 years. Ms.Warden suggested that the dwelling may need to be condemned. <br /> Chair Baumgaertel was not in attendance at the prior meeting at which this matter was discussed. <br /> He expressed concern that an adult with a child was residing in the camper at the property,as he <br /> did not think that was permitted. Mr.Harrington stated that use of a camper was not allowed for <br /> more than 30 days without prior approval from the Board of Health and, in those instances, the <br /> camper must be tied into septic and have running water. He further stated that he was making <br /> inquiries as to having the occupants move onto tribal property or into tribal housing. With respect <br /> to the dwelling, Mr. Harrington stated that if, upon inspection, it is deemed unfit for human <br /> habitation,the Board can order it condemned. <br /> Chair Baumgaertel noted in the Health Agent's comments that Town Counsel had advised that, if <br /> the property is deemed a nuisance, it can be handled under the state Sanitary Code, and follow <br /> the same process as the other two similar properties/situations. Mr. Harrington advised that, <br /> Immediately prior to the November Sth meeting, Health Agents had visited the property and <br /> spoken with the owner's niece,who was occupying the camper. She had begun cleaning up the <br /> property,which is why Town Counsel had delayed issuance of a complaint in court.
