provisions of Chapter 293 of the Acts of 1998 (An Act Relative to the Establishment of the Cape Cod Open Space Land Acquisition Program); and further that the additional sum of $20,000 is hereby raised and appropriated to the Issuance of Debt Account; and further, that the Board of Selectmen and/or Conservation Commission are each authorized to apply for and accept Federal, State and/or County grants, including reimbursement under Chapter 132A, Section 11 of the Massachusetts General Laws, the "Self-Help Act", to be applied by the Town toward the financing of this purchase, and to enter into contracts or agreements with Federal, State and/or County agencies, private conservation trusts or other entities or persons in connection with the purchase of such land and its preservation for conservation purposes, including enforcement of conservation restrictions on the land, and finally, that the Town Conservation Commission and the Board of Selectmen are each hereby authorized to enter into any and all agreements and execute any and all instruments as may be necessary on behalf of the Town to effectuate the purposes of this vote. Motion made to amend at 8:43 p.m. Motion to amend defeated at 8:147 p.m. Motion passes by 2/3rd at 8:48 p.m. Article 13 To see if the Town will vote to authorize and empower the Board of Selectmen to prepare a plan relocating, laying out and defining Lowell Road between Great Neck Road North and Old Barnstable — Falmouth Road, and to accomplish said purpose and for expenses incidental and related thereto, the Town vote to raise and appropriate or transfer from available funds $5,000 to the Lowell Road Roadways,Account, or take any other action relating thereto. Submitted by Board of Selectmen Explanation-, This article would authorize the Selectmen to prepare a formal layout plan of Lowell Road, including relocation of the road at Great Neck Road North to provide a safer intersection, and provide funding for said plan. Although the road has been used as a public way for many years, it does not appear that the formal layout required by state law was ever prepared or adopted by the Town. Recommendation: The Finance Committee recommends approval. Motion made by John Cahalane. Motion: I move the Town vote to authorize and empower the Board of Selectmen to prepare a plan relocating, laying out and defining Lowell Road between Great Neck Road North. and Old Barnstable — Falmouth Road and further the Town vote to appropriate and transfer from Revenue Available for Appropriation $5,000 to the Lowell Road Roadways Account. Recommendation: Finance Committee recommends approval. Motion passes at 8:50 p.m.
