Explanation-, This article is intended to allow flexibility in the requirement of 10 foot natural / <br /> landscaped buffers to accommodate situations such as village-style development where such <br /> buffer strips may run counter to the intended design character of the area. <br /> The Board of Selectmen recommends approval. <br /> The Finance Committee recommends approval by a vote of 4-�0. <br /> Planning Board voted at a Public Hearing held on September 20, 2006 5-0 to recommend <br /> approval. <br /> Motion made by Selectman John Cahalane. <br /> Motion: I move Article 28 be voted as printed in the warrant, except for the phrase "or take any <br /> other action relating thereto". <br /> Motion passes unanimously at 8:18 PM. <br /> Article 29 <br /> To see if the Town will vote to amend the Zoning By-law by amending section 17447 as <br /> follows.. <br /> Change the heading of Section 174-47 to "Cluster development." <br /> Amend Subsection A. and Subsections B.(I)through (5) to read as follows-, <br /> "A. The purposes of this Section are to encourage the preservation of open space, to reduce <br /> .L X I <br /> the impact of new development on the Town's water quality and natural resources, to promote <br /> the more efficient use of land and municipal infrastructure, and to protect and promote the <br /> health, safety and general welfare of the inhabitants of the town. <br /> B. The Planning Board may grant a special permit approving a cluster development in any <br /> residential zoning district for a tract of land, containing at least twice the minimum lot area <br /> required in the applicable zoning district, in which some or all of the lots do not conform to the <br /> upland lot area, frontage, setback (except from water or wetlands) or yard requirements of <br /> Article VII of this chapter. For any parcel of five (5) acres or more in area, no subdivision in a <br /> residential zoning district may be approved except pursuant to a special permit for a cluster <br /> development under the provisions of this section or of Section, 174-46, except that the Planning <br /> Board may waive this requirement upon written request from the applicant where, at its sole <br /> discretion, the Planning Board finds, that the applicant has demonstrated that a cluster <br /> development will not achieve the purposes of this Section as effectively as a conventional <br /> subdivision. Approval shall require that the Planning Board makes a finding that the public good <br /> will be served and that the following criteria are met. <br /> (1) The proposed plan will promote the purpose of this section and shall be superior to a <br /> conventional plan in preserving natural open space, protecting wetlands, wildlife habitats, <br /> 24 <br />
