Insert §170- ., A. Personal Watercraft Operation. <br /> A. All Personal Watercraft operation is subject to the applicable provisions of the <br /> General Laws of the Commonwealth, as amended, and to the further restriction that <br /> no motor or propelled surfboard or other personal watercraft operation is allowed in <br /> Mashpee in or on the freshwater ponds (with the exception of Mashpee-Wakeby <br /> Lake) before the hour of 10:00 a.m. and after the hour of 7:00 p.m. For Mashpee- <br /> Wakeby Lake, personal watercraft are not permitted after the hour of 7:00 PM or <br /> sunset, whichever comes first. (323 CM R 2.13) <br /> Delete §17o- . D. Moorings. <br /> in its entirety and insert the following-, <br /> Insert §170-� . DO Moorings. <br /> D. Fees. The Board of Selectmen shall establish a fee schedule for mooring permits. <br /> The Harbormaster shall be responsible for the annual collection of the fees for <br /> each mooring permit he issues. The revenue collected shall be added to the <br /> Waterways Improvement Fund to be used for dredging or other waterways related <br /> expenses. <br /> Delete §1.70-14. A. Watercraft Operation without Personal Flotation Devices or in <br /> Overloaded or Unsafe Condition. <br /> in its entirety and insert the following-, <br /> Insert §170-14. A. Watercraft Operation without Personal Flotation Devices or in <br /> Overloaded or Unsafe Condition. <br /> A. No person shall operate a vessel in the Town of Mashpee: <br /> (1) Without an approved wearable personal flotation device on board for each <br /> occupant, as required under Chapter 90B, §5 and 323 CMS. 2.07 (10,14,15). <br /> (2) In an overloaded condition as defined in Chapter 90B §12A, and 323 CMR <br /> 2.07 (7). <br /> (3) In an unsafe condition as defined in Chapter 90B § 12A, and 323 CMR 2.07 <br /> (2) Guardrails. <br /> 32 <br />
