Town of Mashpee <br /> Annual Town Meeting <br /> Mash pee High School <br /> October 17, 2005 <br /> Town Meeting opened at 7:55 PM <br /> Voters present - 227 <br /> Quorum Required - 0 <br /> Barnstable, ss: Greetings <br /> To the Constables of the Town, <br /> In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and <br /> summon the inhabitants of the Town of Mas,hpee who are qualified to vote in the elections to <br /> meet at the Mashpee High School on Monday, the 171hday of October, 2005 at 7:30 p.m. for the <br /> following purposes: <br /> To act on the articles contained in the following Warrant. <br /> Article I <br /> To see if the Town will vote that the parcel of Town-owned land shown as "Parcel A" on a plan <br /> entitled "T of nitive Commercial Street Subdivision Plan of Land, Mashpee, Massachusetts" by <br /> Baxter, Nye & Holmgren, Inc., dated 5/23/2003, which is a portion of the parcel shown on the <br /> 2004 Mashpee Assessors' Ma ps as Map 8,1, Block 21, as well as the parcel shown on said <br /> Assessors' 2004 Maps as Map 81, Block 18, the combined area of which is 4.65 acres, more or <br /> 'less, with said parcels located between Route 28 and Commercial Street just north of Madaket <br /> Place, shall not be held by the Town as conservation land; and further, vote that said parcels shall. <br /> be transferred from the care and custody of the Custodian of tax foreclosed property, to the <br /> Board of Selectmen for purposes of sale or lease of all or a portion of said land to a non-profit <br /> entity or entities, with such transfer to be made subject to a deed restriction, which may contain a <br /> reverter clause, restricting the use of said parcel to those uses deemed appropriate by the Board <br /> of Selectmen and subject to certain design guidelines and other conditions which the Board may <br /> deem appropriate; and finally, to authorize the Board of Selectmen to make use of other <br /> instrumentalities of the Town or other agencies and to enter into any agreements necessary, to <br /> effect the transfer of such land in accordance with this Article, or take any other action relating <br /> thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article would authorize the Board of Selectmen to lease or sell all or a <br /> portion of two parcels of land containing approximately 4.65 acres, located between Route 28 <br /> and Commercial Street, just north of Madaket Place, which were previously taken by the Town <br /> for non-payment of taxes, to an appropriate non-profit entity or entities, which may include the <br /> Cape Cod Free Clinic. The land would be permanently restricted to uses deemed appropriate by <br /> the Board of Selectmen (and would also have to conform to applicable zoning), with design and <br /> other conditions specified by the Selectmen, and would be transferred to an agency or <br /> organization selected through a "Request for Proposals" process,.
