§84-7 ENFORCEMENT <br /> A. violations <br /> Any activity that has commenced or is conducted In violation of this Bylaw may be <br /> restrained by written order of the Director of Public Works, by injunction or <br /> otherwise abated in any manner provided,by law. <br /> B. Notice of Violation <br /> When the Department of Public Works determines that an activity is being carried out <br /> in violation of the requirements of this Bylaw, it shall issue a written notice of <br /> violation to the owner of the property and the person responsible for implementation <br /> of the plan. The notice of violation shall contain: <br /> (1) Name and address of the owner and the person responsible for implementation of <br /> the plan; <br /> (2) address of property upon which the violation is occurring; <br /> (3) Statement of the violation; <br /> (4) Description of the remedial measures necessary to bring the activity into <br /> compliance with this Bylaw and a schedule for the completion of such remedial <br /> action; <br /> (5) Statement of the penalty or penalties that shall or may be assessed against the <br /> person to whoa the notice of violation is directed <br /> C. Stop Work Orders <br /> Persons receiving a notice of violation will be required to halt all construction <br /> activities. This "stop work order" will be n effect until. the Department of Public <br /> Works confirms that the development activity is i.n compliance and the violation has <br /> been satisfactorily addressed.. Failure to address a notice of violation in a timely <br /> manner may result in civil, criminal., or monetary penalties in accordance with the <br /> enforcement measures of this Bylaw. <br /> D. Penalties <br /> The penalty for the 1 st violation of this Bylaw shall be $100. The penalty for the 2nd <br /> violation shall be $200. The penalty for the 3rd and subsequent violations shall be <br /> oo.. Each day that a violation. occurs or continues shall constitute a separate offense. <br /> E. Ton.-Criminal Disposition <br /> As an alternative to criminal prosecution or civil action, the Town of 1' ashpee may <br /> elect to utilize the non-criminal disposition procedure set forth in Article II of Chapter <br /> 1 of the General Bylaws of the Town of Mas pee. <br /> 1.1 <br />
