Consulting Engineers and Land Surveyors, Sheets No. I <br /> and 2 of 3", a copy of which is on file with the Office of the Town Manager, for the purposes of <br /> conducting environmental investigation and response activities, including any such work as may <br /> be necessary and incidental thereto, upon such terms and conditions as the Board of Selectmen <br /> may deem appropriate; to authorize the Board of Selectmen to prepare and execute any such <br /> instruments or other documents as may be necessary to effect the conveyance of said easement <br /> rights; and, furthermore, to authorize the Board of Selectmen to petition the Massachusetts <br /> General Court pursuant to Article 97 of the Amendments to the Massachusetts Constitution for <br /> special legislation to authorize the transfer and change in use of the easement area within said <br /> Tract 101F, or take any other action relating thereto. <br /> Submitted by the Board of Selectmen, <br /> Explanation: This article will authorize the conveyance of an easement and right of way over <br /> certain bogland and conservation land located off of Grafton Pocknett Road to the Department of <br /> the Army, New England District Corp. of Engineers, for the purposes of conducting <br /> environmental investigations and remediation activities with respect to a fuel spill at the <br /> Massachusetts Military Reservation. The proposed easement is to be conveyed pursuant to an <br /> Agreement between the Department of the Army and the Board of Selectmen dated January 26, <br /> 2004. Given the current public use of the subject property for conservation/agricultural. <br /> purposes, the Town will be required to petition the General Court pursuant to Article 97 of the <br /> Amendments to the Massachusetts Constitution for special legislation, to authorize a transfer in <br /> change and use of the easement area granted. <br /> Motion made to dispense wit: the reading of Article 22 made at 8:36 p�.m., <br /> Motion to dispense with reading of Article 22 passes at 8:35 p.m. <br /> Motion made by George Green. <br /> Motion-, I move the Town vote to transfer to the Board of Selectmen and authorize the Board to <br /> convey to the United States of America an easement and right of way in, on, over and across <br /> parcel of real estate owned by the Town and identified as Tract No. 101 E, as shown on the Plan <br /> entitled "Easement Plan on Land in Mashpee, MA Scale F — 40', dated March 22, 2002, by <br /> Norwood Engineering Company, Inc.
