the Selectmen deem proper; and further, to authorize the Selectmen to petition the General Court, <br /> as may be necessary, for special legislation authorizing said transfer. <br /> Motion passes unanimously at 7:53PM. <br /> Article 13 <br /> To see if the Town will vote to amend the General By-laws in accordance with the provisions of <br /> the Mashpee Home Rule Charter, Sections 8-5 and 54(b), by adopting the following By-law as <br /> Division 1, Part 1, Chapter 1, Article V, Section 1- , Reorganization of Town Government, <br /> together with the Plan of Reorganization submitted herewith, which shall be appended to the <br /> Town By-laws in the form of an administrative code; further, to adopt proposed General, By-law, <br /> Chapter 5, Article VII, Section 5-3 1, relative to the position of Assistant Town Manager; and to <br /> ,amend the Zoning By-law, Chapter 174, Article XVI, Section 174-92 by deleting the provision <br /> therein relative to employment of clerical staff and other assistance by the Zoning Board of <br /> Appeals, all as set forth below, or take any other action in relation thereto. <br /> GENERAL BYLAWS <br /> Article V, Section 1-6. Reorganization of Town Government. <br /> Pursuant to the provisions of the Mashpee Home Rule Charter, Article V, Section 5-1(b), the <br /> Town Manager has adopted a Reorganization Plan for the orderly, efficient and convenient <br /> conduct of the business of the Town, dated September. 8, 2008, a copy of which is appended to <br /> the Administrative Code section of these Bylaws, wh i ch document is incorporated herein by <br /> reference. Said Reorganization Plan codifies the reorganization of the responsibilities and <br /> structure of the Department of Public Works, in compliance with the provisions of Section 5-8 of <br /> the Charter, expands the duties and responsibilities of the Personnel Department into a Human <br /> Resources Department, reassigns the reporting relationship of the Harbonnaster's Office and the <br /> Office of the Shellfish Warden to the Police Department, reassigns the Global Information <br /> Technology function to fall under the jurisdiction of the Information Technology Department, <br /> reassigns the Zoning Board of Appeals Administrative Assistant to the Department of <br /> Inspectional Services, and creates the position of Assistant Town Manager. Said Administrative <br /> Code I shall remain in full force and effect until amended, supplemented or repealed in <br /> accordance with the provisions of the Charter, Section 5-1. <br /> Article V11, Section 5-31. Assistant Town Manager. <br /> Section 5-31. Appointment- Term of Office. The Town Manager shall appoint an Assistant <br /> Town Manager for a term to be determined by the Town Manager. <br /> Section 5-32. Powers and Duties. The Assistant Town Manager shall serve under the direction <br /> of the Town Manager, and shall perform such duties and tasks as may be assigned or delegated <br /> to him/her by the Town Manager. In the absence of the Town Manager, the Assistant Town <br /> Manger shall have the authority to exercise the powers, duties and responsibilities of the Town <br /> Manger as established by General Law, the Charter or these By-laws. <br /> October To Meeting Warrant <br />
