Town under the provisions of Chapter 293 of the Acts of 1998 (An Act Relative to the <br /> Establishment of the Cape Cod Open Space Land Acquisition Program) $1,600 for such purpose, <br /> including expenses incidental and related thereto; and further, to see if the Town will authorize <br /> the Board of Selectmen to enter into contracts or agreements with Federal, State and/or County <br /> agencies, private conservation trusts or other entities or persons in connection with the purchase <br /> of such land, including enforcement of restrictions on the land; and finally, to see if the Town <br /> will authorize the Board of Selectmen to enter into agreements and execute any and all <br /> instruments as may be necessary on behalf of the Town to effectuate said acquisition; or take any <br /> other action relating thereto. <br /> Submitted by Open Space Committee <br /> Explanation: This article would authorize the Board of Selectmen to purchase, using Land <br /> Bank funds, a small wetland lot surrounded by the previously-purchased "Belcher" property off <br /> Lowell Road. The lot also has the benefit of a right-of-way over the Town's land from Lowell <br /> Road. This purchase would consolidate the Town's ownership in the area and avoid any <br /> potential legal or development issues related to the lot and right-of-way. <br /> 0 A-0 <br /> Motion made to dispense witn reading of article. <br /> Motion to dispense with reading of article passes at 8:07 p.m. <br /> Motion made by Wayne Taylor. <br /> Motion: I move the Town vote to authorize the Selectmen to acquire, by purchase or otherwise, <br /> for the purposes allowed by Chapter 293 of the Acts of 1998, that parcel of land identified on the <br /> FY2001 Mashpee Assessors' Maps as Map 60, Block 1, consisting of 16,353 square feet, more <br /> or less, located off Lowell Road and surrounded by the so-called "B,elcher Property" previously <br /> purchased by the Town, along with any appurtenant easements or rights-of-way; and further, the <br /> Town vote to appropriate and transfer from the Land Bank Fund established by the Town under <br /> the provisions of Chapter 293 of the Acts of 1998 (An Act Relative to the Establishment of the <br /> Cape Cod Open Space Land Acquisition Program) $1,600 for such purpose, including expenses <br /> incidental and related thereto; and further, the Town vote to authorize the Board of Selectmen to <br /> enter into contracts or agreements with Federal, State and/or County agencies, private <br /> conservation trusts or other entities or persons in connection with the purchase of such land, <br /> including enforcement of restrictions on the land; and finally, the Town vote to authorize the <br /> Board of Selectmen to enter into agreements and execute any and all instruments as may be <br /> necessary on behalf of the Town to effectuate said acquisition. <br /> Motion passes unanimously at 8:08 p.m. <br /> Article 12 <br /> To see if the Town will vote to transfer the care, custody, maintenance and control of the parcel <br /> of land described below from the Tax Collector for purposes of sale under G.L. c.60 to the Board <br /> of Selectmen for purposes of sale and to authorize the Board of Selectmen to sell the following <br /> described parcel of land on such terms and conditions as they may determine: <br />
