The land is also proposed to be purchased by the Commonwealth of Massachusetts using federal <br /> funds, and this article is proposed only as a backup in the event that the state purchase does not <br /> occur. <br /> with <br /> I <br /> Motion made to dispense wit,n reading of article. <br /> Motion to dispense with reading of article passes at 8:00 p.m. <br /> Motion made by John Cahalane. <br /> Motion: I move the Town vote to authorize the Selectmen to acquire, by purchase or otherwise, <br /> for conservation and passive recreation purposes, all or a portion. of that parcel of land identified <br /> on the 2001 Mashpee Assessors' Maps as Map 115, block 20, consisting of 3,5 acres, more or <br /> less, located between Great Hay Road, Hush Road, Great Oak Road and Abigail's Brook, to be <br /> held in the care and custody of the Conservation Commission pursuant to Massachusetts General <br /> Laws Chapter 40, Section 8C for conservation and passive recreation purposes; and further the <br /> Town vote to appropriate $593,200 for such purpose, including expenses incidental and related <br /> thereto, and to raise such appropriation, the Treasurer, with the approval of the Selectmen, be <br /> authorized to borrow $5931,200 under and pursuant to Chapter 44, Sections 7 and 8C and, if <br /> applicable, Chapter 40, section 8C of the General laws, or any other enabling authority, and to <br /> issue bonds or notes of the Town therefor; with said borrowing to be repaid with funds from the <br /> Land Bank Fund established by the Town under the provisions of Chapter 293 of the Acts of <br /> 1998 (An Act Relative to the Establishment of the Cape Cod Open Space Land Acquisition <br /> Program); and further vote to raise and appropriate $3,000 to the Issuance of Debt Account; and <br /> further authorize the Board of Selectmen and Conservation Commission to apply for and accept <br /> Federal, State and/or County grants, including reimbursement under Chapter 132A, Section 11 <br /> of the General Laws, the "Self-Help Act", to be applied by the Town toward the financing of this <br /> acquisition, and to enter into contracts or agreements with Federal, State and/or County agencies, <br /> private conservation trusts or other entities or persons in connection with the purchase of all or a <br /> portion of such land and its preservation for conservation and passive recreation purposes, <br /> including conveyance and enforcement of a perpetual conservation restriction on the land in <br /> accordance with Chapter 184 of the General Laws as required by the provisions of Chapter 293 <br /> Section 10 of the Acts of 1998 as amended, to the Orenda Wildlife Land Trust or any other <br /> organization qualified and willing to hold such a restriction; and finally, the Town authorize the <br /> Conservation Commission and the Board of Selectmen to enter into agreements and execute any <br /> and all instruments as may be necessary on behalf of the Town to effectuate said acquisition and <br /> preservation. <br /> Motion passes unanimously at 8:06 p.m. <br /> Article I I <br /> To see if the Town will vote to authorize the Selectmen to acquire, by purchase or otherwise, for <br /> the purposes allowed by Chapter 293 of the Acts of 1998, that parcel of land identified on the <br /> F'Y2001 Mashpee Assessors' Maps as Map 60, Block 1, consisting of 16,353 square feet, more <br /> or less, located off Lowell Road and surrounded by the so-called "Belcher Property" previously <br /> purchased by the Town, along with any appurtenant easements or rights-of-way; and further, to <br /> see if the Town will vote to appropriate and transfer from the Land Bank Fund established by the <br />
