municipalities, private conservation trusts or other entities or persons in connection with the
<br /> purchase and management of such land and its preservation for conservation purposes, including
<br /> the grant of conservation restrictions on the land; and finally, to see if the Town will authorize
<br /> the Board of Selectmen to enter into agreements and execute any and all instruments as may be
<br /> necessary on behalf of the Town to effectuate said acquisition, sale, transfer or preservation; or
<br /> take any other action relating thereto.

<br /> Explanation: This, article re-writes Article 12 of the October 1, 2001 Town Meeting to allow
<br /> for the purchase of all property owned by the developers of the proposed "Cape Club" golf
<br /> course and/or within the boundary of the proposed development 'including a parcel not
<br /> contiguous to the original site. Additionally, the new article adds language that will allow for the
<br /> possible purchase of the entire proposed golf project in a joint venture with the Town of
<br /> Barnstable and the Commonwealth of Massachusetts under terms, and conditions to be
<br /> negotiated. Language in the original article unintentionally precluded acceptance of$3,200,000
<br /> of State funds and a cooperative management agreement with the Town of Barnstable that may
<br /> be necessary for the purchase of the entire parcel. The present article accommodates as many
<br /> scenarios as possible while continuing to allow for the possibility that Mashpee alone can
<br /> purchase any portion of the proposed project should it become available.

<br /> all or a portion of certain parcels of land shown on the 2000 Mashpee Assessors' Maps as Map
<br /> 23, Blocks 20, 241, 301 361 421 461 48, 491 51, 541 561 571 661, 68 and 212, Map 30, Blocks 52, 53,
<br /> 841 851 871 881 911 941 971 1041 1051 1071 1081 1111 1381 139 and 140 and the land contained in
<br /> the layouts of the "paper" streets known as Wimbledon Way and Racquet Drive, Map 31, Block
<br /> I, Map 37, Block 55, Map 38, Blocks 1, 51, 6, 7, 9, 10, 11, and 25, Map 47, Block 21 and Map
<br /> 51, Block 5, as well as those parcels of land shown on the Town of Barnstable Assessors' Maps
<br /> as Map 11, Parcels 1, 2 and 3, Map 12, Parcel 8 and Map 26, Parcels 1, 40-1, 41, 42 and 46 and
<br /> the land contained in the layout of the "paper" street known as Wimbledon Way, along with
<br /> those portions of adjacent street layouts which are appurtenant to any of said parcels; that the
<br /> Town raise and appropriate $3,200,000 for such purpose, including expenses incidental and
<br /> related thereto, and to meet such appropriation, the Treasurer, with the approval of the
<br /> Selectmen, be authorized to borrow $3,200,000 or any other sum under and pursuant to Chapter
<br /> 44, Sections 7 and 8C of the Massachusetts General, Laws, or any other enabling authority, and
<br /> to issue bonds or notes of the Town therefor; said borrowing to be repaid with funds from the
<br /> Land Bank Fund established by the Town under the provisions of Chapter 293 of the Acts of
<br /> 1998 (An Act Relative to the Establishment of the Cape Cod Open Space Land Acquisition
<br /> Program); and further, that the Board of Selectmen is hereby authorized to apply for and accept
