Surveying and Engineering, Inc., which layout shall have been filed in the Office of the Town Clerk, not later than seven days prior to the date of the vote hereunder and to authorize the Board of Selectmen to acquire by gift, purchase or eminent domain taking any land necessary for the purpose of such way as so laid out, and to raise and appropriate and/or transfer from available funds for appropriation $263,388 to the Algonquin Avenue Roadways Account to effect the conversion of Algonquin Avenue from a private way to a public way and to raise said appropriation the Treasurer, with the approval of the Board of Selectmen, be authorized to borrow at one time, or from time to time said sum, under and pursuant to Chapter 44, Section 7 or 8 or any other enabling authority and to issue bonds and notes of the Town therefore; and to further authorize the Board of Selectmen to assess betterments to the owners of the land abutting the ways, or take any other actions relating thereto. Submitted by the Board of Selectmen Explanation: This article will authorize the conversion of a private way to a public way. Algonquin Avenue has become a matter of public safety. The Code of the Town of Mashpee allows for the Board of Selectmen to convert private roadways and assess betterments to the abutting property owners. Recommendation: The Finance Committee recommends approval. Motion made to dispense witti the reading of article. Motion to dispense with reading of article passes at 9:23 p.m. Motion made by Kenneth Marsters. Motion: I move that the Town vote to accept the layout of Algonquin Avenue as a public way, as shown on the plan entitled "Taking Plan of Land in Mashp�ee, MA" dated August 15, 1997, by Eagle Surveying and Engineering, Inc., which layout shall be filed in the Office of the Town Clerk, not later than seven days prior to the date of the vote hereunder; that the Board of Selectmen is hereby authorized to acquire by gift, purchase or eminent domain taking any land necessary for the purpose of such way as so laid out; that the sum of $263,388 is hereby appropriated to pay costs of converting Algonquin Avenue from a private way to a public way; that to meet this appropriation, the Treasurer, with the approval of the Board of Selectmen, is hereby authorized to borrow said amount at one time, or from time to time, under and pursuant to Chapter 44, Sections 7 or 8 or pursuant to any other enabling authority and to issue bonds and notes of the Town therefor; and that the Board of Selectmen are hereby further authorized to assess betterments to the owners of the land abutting the ways to be benefited by the work to be undertaken pursuant to this vote.
