Page 6 Special Town Meeting - October 21, 1970 Article 11 : To see if the Town will vote to amend the zoning map of tFie Town of Mashpee so that the following described premises are included within the Marine District rather than the R150 District : The land in Mashpee, said County of Barnstable bounded and described as follows : Beginning at a point on the Westerly side of Ockway Bay; Thence N 760 09m 25" W 354. 24 feet, more or less , to a point at a concrete bound; Thence N 49' 45 ' 40" E 60 feet to a concrete bound; Thence S 790 41 ' 10" E 245 . 32 feet to a concrete bound; Thence N 21' 33 ' 40" E 108 . 37 feet to a concrete bound; Thence S 68' 26 ' 20" E 100 feet, more or less , to Ockway Bay; and thence by Ockway Bay to the point of beginning. Containing 30, 300 .square feet of land, more or less , and being further described and delineated on a plan of land - Mashpee, Mass. , Scale 1 in. = 100 feet, June 1968, Whitney and Bassett -- Architects & Engineers - Hyannis , Mass . , Being a subdivision of Lot 2 shown on Land Court Plan 16716B to be shown as Subdivision Plan 16716B. Submitted by John Warner. (This Article is not approved as to form or substance by Town Counsel . Proposed change might well constitute spot Zoning. Also, there should be an advisory report by Planning Board filed with Town Meeting. The Town cannot act unless twenty (20) days have elapsed before a report having been filed. ) From the floor: I move that Article 11 be tabled. (Seconded. ) Moderator : Any discussion? Richardson Jonas (Chmn of Planning Bd. ) I think it would be no more than fair to let Town Counsel explain the addition at the end of the article . This makes it sound like it is not legal or something. Moderator : I personally skipped reading this addition because I feel it has nothing to do with the article as presented and to be acted upon by this town meeting. As far as I am concerned, it should not be in there. Rollins : Since there is a motion to table - it would seem there is no need to discuss. Moderator: I don' t feel it is fair to call for a yea or nay vote on this without some discussion. Lt ways simply an oversight that no provision was made for access to the water This is ust an extension to ive access . A public marina in this area wou�d be a distinct asset.
