No other comments. <br /> Mr. Smith commented that we could allow the project to proceed with a condition that the <br /> applicant work with Agent until he is satisfied with the mitigation planting scheme and not <br /> come back for a vote. <br /> Mr. Sweet said the applicants are laying the work on the Agent instead of making a plan that <br /> makes sense and answers the violations that already occurred. <br /> Dan Ojala mentioned some changes they could make regarding mitigation/species/location. <br /> Mr. Sweet said he's still not comfortable with this, there's enough issues we need a <br /> continuance. <br /> Agent said the old shed was discussed as a consideration to the unpermitted shed. Thomas Bunker from BSS Design and Andrew Garulay from Yarmouthport Design <br /> Group presented plans. Agent we want to make sure if the homeowners intend to preserve <br /> the view and do pruning or cutting, it will require a vista pruning permit. It has nothing to do <br /> with what you're presenting tonight,more of an FYI. Performance standards are met, no other <br /> comments. <br /> Catherine Hargenon from 9 Kim Path made a public comment in regards to the large oak tree <br /> that is proposed to be cut down, she asked that the removal of this oak be reconsidered, or at <br /> least only some of the branches be removed to keep some of the natural landscape between <br /> the homes. Andrew Garulay said the obstacle is they have to retain the driveway, the original <br /> intent was to save the oak tree, but as the plan developed we had to make sure the grading <br /> would work and that the homeowners can get their car in there. Catherine Hargenon said it's <br /> a shame. Andrew Garulay explained they have to put fill up against it and the tree would not <br /> survive. <br /> Mr. Smith asked,if.there's on opportunity for mitigation that could be enjoyed by the,abu.tter. r,.. <br /> Andrew Garulay said unfortunately there is no room for a tree there. <br /> Motion: Mr. Sweet moved to close and issue, Mr. O'Neil seconded. <br /> Vote: 6-0 unanimous <br /> 6:24 Peter R. & Carolie D. Andrew Garulay said they were not proposed to be <br /> removed Agent provided feedback on the proposal and said the mitigation plan greatly <br /> enhances the buffer zone. No other comments. <br /> Motion: Mr. Sweet moved to close and issue, Mr. O'Neil seconded. <br /> Vote: 6-0 unanimous <br />
