Motion passes at 8:26 p.m. <br /> Article 30 <br /> To see if the Town will vote to authorize the Board of Selectmen to exercise the option held by <br /> the Town as set forth in paragraph 3 of the agreement entitled "South Cape Beach Development <br /> Agreement" between the Town, acting through its Board of Selectmen, and the Commonwealth <br /> of Massachusetts acting by and through its Department of Environmental Management <br /> ("DEM"), dated December 27, 1990, to acquire certain lands of the Commonwealth and 'in <br /> consideration therefore to convey to the Commonwealth certain lands of the Town, as such <br /> exchange is further described in Chapter 287 of the Acts of 1982; to authorize such acquisition <br /> and conveyance on such terms and conditions as the Board of Selectmen may determine, which <br /> may include restrictions on the future use of said, lands, the land, to be acquired by the Town <br /> being described in, paragraph 15 of the agreement entitled "Amended Agreement" between the <br /> Town and DEM dated July 15, 1981, and consisting of approximately 30 acres as shown on the <br /> map attached to said Amended Agreement as Exhibit B and the land to be conveyed by the <br /> Town being described in paragraph 14 of said Amended Agreement as "all municipally owned <br /> lands within the proposed boundaries of the [Soï¿œuth Cape Beach State] Park," including the <br /> existing town beach and a portion of Great Oak Road and other parcels within said Park; and to <br /> ,authorize the Board of Selectmen to petition the General Court of the Commonwealth for such <br /> approvals as may be needed for such exchange pursuant to Article 97 of the Amendments to the <br /> Massachusetts Constitution. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article seeks to establish the intent of the Town to exercise its option <br /> negotiated with the Commonwealth of Massachusetts as part of the "South Cape Beach <br /> Development Agreement"' for the transfer of the new South Cape State Beach to the control and <br /> ownership of the Town and the transfer of the Town's South Cape Beach to the State. The <br /> following Article seeks to carry out this intent by authorizing the actual transfer of title to these <br /> properties. <br /> Motion made by Morris Kirsner.. <br /> Motion.- I move the Town vote to authorize the Board of Selectmen to exercise the option held <br /> by the Town under the South Cape Beach Development Agreement as printed in the warrant <br /> except for the phrase "or take any other action relating thereto". <br /> Motion made to indefinitely postpone passes at 8:43 p0m* <br /> Move to reconsider defeated 8:44 p.m. <br /> Article 31 <br /> To see if the Town will vote to transfer the care, custody, management and control of the Town <br /> owned land described in paragraph 14 of the July 15, 1981 "Amended Agreement" between the <br /> Town and the Massachusetts Department of Environmental Management ("DEM") as "all <br /> municipally owned lands within the proposed boundaries of the [South Cape Beach State] <br /> Park," including the existing town beach and a portion of Great Oak Road and other parcels <br /> within said Park, being the land shown on Assessor's Map 130, Block 6, to the Selectmen for <br /> 26 <br />
