the purpose of conveyance to the Commonwealth of Massachusetts pursuant to the option held <br /> by the Town under the agreement entitled "South Cape Beach, Development Agreement" <br /> between the Town and DEM dated December 271 1990, on such terms and conditions as the <br /> Board of Selectmen may determine, which may include restrictions on the future use of said <br /> land. <br /> Submitted by the Board of Selectmen <br /> Explanation: This Article carries out the intent established in the previous Article to exercise <br /> the Town's option negotiated with the Commonwealth. of Massachusetts as part of the "South <br /> Cape Beach Development Agreement". through this Article the actual transfer of title is <br /> approved to transfer the Town's South Cape Beach to the State and to accept ownership and <br /> control of the State's new South Cape State Beach. <br /> Motion made by Morris Kirsner'. <br /> Motion: I move the Town vote to transfer the care, custody, management, and control of the <br /> land described in Article 31 to the Selectmen for conveyance to the Commonwealth of <br /> Massachusetts as printed in the warrant except for the phrase "or take any other action relating <br /> thereto". <br /> Move to indefinitely postpone passes at 8:45 pems <br /> Article 32 <br /> To see if the Town will vote to authorize and empower the Board of Selectmen to prepare a <br /> plan laying out and defining Algonquin Avenue and to accomplish said purpose and for <br /> expenses incidental and related thereto, the Town vote to raise and appropriate or transfer from <br /> available funds for appropriation the sum of $5,000 to the Algonquin Avenue Account and to <br /> raise said appropriation the Treasurer with the approval of the Board of Selectmen be authorized <br /> to borrow at one time, or from time to time, the sum of$5,000 under and pursuant to Chapter <br /> 44, Section 7 or 8 or any other enabling authority and to issue bonds and notes of the Town <br /> therefore, and further, to see if the Town will vote to raise and appropriate or transfer from <br /> available funds a sum of money to the Algonquin Avenue Account to provide interest and debt <br /> issuance expenses. <br /> Submitted by the Board of Selectmen <br /> Explanation: This Article is placed on the warrant by the recommendation of the Department <br /> of Public Works and the approval of the Board of Selectmen as provided for under Mashpee <br /> Code 4,50-7. <br /> Recommendation:,, Finance Committee recommends approval. <br /> Recommendation: Planning Board recommends approval. <br /> Motion made by Selectman Dinizio. <br /> Motion: I move the Town vote to authorize and empower the Board of Selectmen to prepare a <br /> 27 <br />
