entities or persons in connection with the purchase of such land and its preservation for

<br /> Motion: The Board of Selectmen be authorized to acquire by purchase or otherwise, for
<br /> conservation purposes, a parcel of land, being a portion of that land shown on a "Plan of Land
<br /> in Mashpee, Mass. Prepared for the Bufflehead Bay Nominee Trust," revised. date November 6,
<br /> 1 51 by Hayes Engineering, Inc. of Wakefield, rIA, as well as portion of the land. shown on
<br /> Land Court Plan 4042 A, said land also being portions of those parcels shown on the 1995
<br /> Mashpee Assessors Maps as Map 11 , Blocks 1, 6, 7, and. 8, generally located. between Upper
<br /> Great Diver Road, Jehu Pond, Abigail's Brook and Great Oak Road, to be held in the care and
<br /> custody of the Conservation Commission pursuant to Massachusetts General Laws Chapter 40,
<br /> Section 8C; and further, that $500,000 be appropriated for such purpose, including expenses
<br /> incidental and related thereto, and to raise such appropriation, the Treasurer, with the approval
<br /> of the Selectmen be authorized to borrow $500,000 under and pursuant to Chapter 44, Sections
<br /> 7" and 8C and if applicable, Chapter 40, Section 8C, of the General Laws, or any other enabling
<br /> authority,ort y, and to issue bonds or notes of the Town therefor, provided that no bonds or notes o
<br /> the Town shall be issued unless and until grant agreement has been executed between the Town
<br /> and the Commonwealth of Massachusetts for reimbursement to the Town in the amount of at
<br /> least $250,000 under MGL, Chapter 1. 2A, Section 11, or any other applicable law; and further
<br /> that oo be transferred from revenue available for appropriation to the Issuance of Debt
<br /> Account; and further that the Board of Selectmen and/or Conservation Commission be
<br /> authorized to apply for and accept Federal and/or State grants, including reimbursement under
<br /> Chapter 13 A, Section 11 of the General Laws, the "Self Help Acts" to be applied by the Town
<br /> toward the financing of this purchase, and to enter into contracts or agreements with Federal
<br /> and/or State agencies, private conservation trusts or other entities or persons in connection with
<br /> the purchase of such land and its preservation for conservation purposes; and finally that the
<br /> Conservation. Commission. and the Board of Selectmen be authorized to eater into agreements
<br /> and execute any and all instruments as may be necessary on behalf of the Town to effectuate
<br /> said acquisition.
