west side of Meetinghouse Road,just north of the intersection of the latter with Hanson Drive, to be held in the
<br /> care and custody of the Conservation Commission pursuant to Massachusetts General Laws Chapter 40, Section
<br /> 8C; and further, to see if the Town will vote to raise and appropriate, borrow, or transfer from available funds
<br /> $185,000 for such purpose, including expenses incidental and related thereto, and to raise such appropriation, the
<br /> Treasurer, with the approval of the Selectmen be authorized to borrow $185,000 or any other sum under and
<br /> pursuant to Chapter 44, Sections 7 and 8C and if applicable, Chapter 40, Section 8C of the General Laws, or any
<br /> other enabling authority, and to issue bonds or notes of the Town therefor; and further, to see if the Town will
<br /> vote to raise and appropriate or transfer from available funds $400 to the Issuance of Debt Account; and further,
<br /> to see if the Town will authorize the Board of Selectmen and/or Conservation Commission to apply for and
<br /> accept Federal, State and/or County grants, including reimbursement under Chapter 132A, Section 11 of the
<br /> General Laws, the "Self-Help Act" and/or grants under Barnstable County's "Cape Cod Pathways" program, to
<br /> be applied by the Town toward the financing of this purchase, and to enter into contracts or agreements with
<br /> Federal, State and/or County agencies, private conservation trusts or other entities or persons in connection with
<br /> the purchase of such land and its preservation for conservation purposes ; and finally, to see if the Town will
<br /> authorize the Conservation Commission and the Board of Selectmen to enter into agreements and execute any
<br /> and all instruments as may be necessary on behalf of the Town to effectuate said acquisition; or take any other
<br /> action related thereto.

<br /> Explanation: This article would authorize the Board of Selectmen to purchase, on behalf of the Conservation
<br /> Commission, all or a portion of the last unprotected/undeveloped parcel of land on the Mashpee River. The
<br /> Trustees of Reservations, which owns the land on both sides of this parcel as part of its Mashpee River
<br /> Reservation, has agreed to purchase the western third of this property for one third of the purchase price of
<br /> $185,000. Of the remaining $123,333, the Town will apply for a $50,000 grant from Barnstable County's Cape
<br /> Cod Pathways program, which can be used toward the Town's match of a Massachusetts Self-Help program
<br /> grant, which would pay 52% of the cost of the portion of the property purchased by the Town, or $64,133, if
<br /> received. As a result, the Town may be able to acquire the proposed 2/3 of this property for $9200 of Town
<br /> funds, plus any costs for short-term borrowing while we await the state grant reimbursement.
<br /> Recommendation: Finance Committee recommends approval.

<br /> Motion: I move that the Board of Selectmen is hereby authorized and directed to acquire by gift, by purchase,
<br /> by eminent domain or otherwise, for conservation purposes, all or a portion of a certain parcel of land, being that
<br /> land shown on a "Plan of Land in Mashpee of Edwin White" by Charles Savery dated October 15, 1970, also
<br /> being shown on the 1997 Mashpee Assessors' Maps as Map 53, Block 2, containing 16.85 acres, more or less,
<br /> located between the Mashpee River and the west side of Meetinghouse Road,just north of the intersection of the
<br /> latter with Hanson Drive, which land shall be held in the care of the Conservation Commission pursuant to
<br /> Chapter 40, Section 8C of the Massachusetts General Laws, that the sum of$185,000 is hereby appropriated, to
<br /> be expended at the direction of the Board of Selectmen, to acquire the aforesaid property and to pay all other
<br /> costs incidental and related thereto, and that to meet this appropriation, the Treasurer, with the approval of the
<br /> Selectmen, is hereby authorized to borrow said sum under and pursuant to Chapter 44, Section 7 (3) of the
<br /> Massachusetts General Laws, or any other enabling authority, and to issue bonds or notes of the Town therefor,
<br /> that the sum of$400 is hereby raised by taxation and applied to the Issuance of Debt Account in connection with
<br /> the issuance of bonds or notes hereunder; that the Board of Selectmen and the Conservation Commission are
