of Selectmen to enter into agreements and execute any and all instruments as may be necessary on behalf of the <br /> Town to effectuate said acquisition; or take any other action related thereto. <br /> Submitted by Conservation Commission <br /> Explanation: This article would authorize the board of Selectmen to acquire, by eminent domain taking if <br /> necessary, a parcel of land on Great Oak Road which is surrounded by Town and U.S. Fish & Wildlife Service <br /> lands at the so-called "Bufflehead Bay" site which has recently been subdivided and is imminently threatened with <br /> development. The property is within the boundaries of the Mashpee National Wildlife Refuge. The Town will <br /> apply for a 52% grant reimbursement under the state's Self-Help Land Acquisition program to help defray the <br /> cost of this property. <br /> Recommendation: Finance Committee recommends approval. <br /> Motion made by George Costa. <br /> Motion: I move that the Board of Selectmen is hereby authorized and directed to acquire by gift, by purchase, <br /> by eminent domain or otherwise, for conservation purposes, all or a portion of that land shown as lots 1,2,3, and <br /> 4 on a "Plan of Land in Mashpee, Massachusetts. Prepared for Tremont at Union Limited Partnership"by Down <br /> Cape Engineering, Inc., and dated December 18, 1997, also being shown on the 1997 Mashpee Assessors' Maps <br /> as Map 116, Block 1, containing 6.2 acres, more or less, located on the west side of Great Oak Road,just south <br /> of Abigail's Brook, which land shall be held in the care of the Conservation Commission pursuant to Chapter 40, <br /> Section 8C of the Massachusetts General Laws, that the sum of$220,000 is hereby appropriated, to be expended <br /> at the direction of the Board of Selectmen, to acquire the aforesaid property and to pay all other costs incidental <br /> and related thereto, and that to meet this appropriation, the Treasurer, with the approval of the Selectmen, is <br /> hereby authorized to borrow said sum under and pursuant to Chapter 44, Section 7 (3) of the Massachusetts <br /> General Laws, or any other enabling authority, and to issue bonds or notes of the Town therefor, that the sum of <br /> $400 is hereby raised by taxation and applied to the Issuance of Debt Account in connection with the issuance of <br /> bonds or notes hereunder; that the Board of Selectmen and the Conservation Commission are each authorized <br /> and directed to apply for and accept any and all Federal, State or County grants that may be available for <br /> acquisition of the aforesaid property and that the Board of Selectmen and the Conservation Commission are each <br /> hereby authorized to enter into agreements and execute any and all instruments as may be necessary or <br /> convenient in connection with the aforesaid land acquisition. <br /> Motion passes at 9:24 p.m. <br /> Article 24 <br /> To see if the Town will vote to transfer the custody and control of those parcels of land shown on the 1997 <br /> Mashpee Assessors' Maps as Map 110, Blocks 67, 70 and 71, containing approximately 32.25 acres, to the care <br /> and custody of the Conservation Commission, pursuant to Massachusetts General Laws Chapter 40, Section 8C, <br /> or take any other action related thereto. <br /> Submitted by Conservation Commission <br /> and Board of Selectmen <br /> Explanation: This article would designate 32.25 acres of tax taking land owned by the Town, located south of <br /> 25 <br />
