Court for legislation to permit municipal debt issuance for said study purpose.
Motion made to amend to defer study.
Motion to amend defeated at 9:43 p.m.
Motion passes unanimously at 9:46 p.m.
Article 29
To see if the Town will vote to adopt the Mashpee Comprehensive Plan, as approved and recommended by the
Mashpee Planning Board acting as the Town's Local Planning Committee, pursuant to Section 9 of Chapter 716
of the Acts of 1989, the "Cape Cod Commission Act", which Plan is available for inspection and review at the
offices of the Town Clerk and Town Planner, Town Hall, 16 Great Neck Road North, Mashpee during weekday
business days from 8:30 a.m. to 4:30 p.m., or take any other action related thereto.
Submitted by Planning Board/
Local Planning Committee
Explanation: This article would formally adopt a Comprehensive Plan, as drafted by the Planning Department
working with a variety of Town departments, boards and volunteer committees and as approved by the Planning
Board, which was appointed by the Board of Selectmen to serve as the Town's "Local Planning Committee" to
prepare and approve such a plan under the provisions of the Cape Cod Commission Act. The Comprehensive
Plan includes sixteen "elements" dealing with Affordable Housing, Economic Development, Coastal Resources,
Water Resources, Water & Wastewater Facilities, Open Space/Recreation & Agriculture, Wetlands /Wildlife &
Plant Habitat, Public Safety, Solid & Hazardous Waste, Municipal Buildings & Facilities, School Facilities,
Transportation, Energy, Health & Human Services, Heritage Preservation & Community Character and Land
Use & Growth Management. Each element includes recommended goals, objectives and policies and an action
plan suggesting capital facilities needed by the Town both over the next five years and in the long term,
recommended regulatory changes and other actions intended to accomplish the identified goals and objectives.
The Plan is also intended to be consistent with the Regional Policy Plan adopted by Barnstable County. Once
such consistency is certified by the Cape Cod Commission, the Town will be legally empowered to adopt and
implement a system of impact fees (requiring approval by Town Meeting and the Cape Cod Commission) to help
offset the new capital facilities needs created in the Town by new development or redevelopment and to enter
into "development agreements" with the developers of major projects, the Cape Cod Commission and state
agencies to establish the terms on which large projects may be developed in a phased manner over a number of
years. Upon adoption and Commission certification of the Comprehensive Plan, any "Development of Regional
Impact" reviews and approvals by the Commission must be consistent with the Comprehensive Plan. The
regulatory recommendations of the Plan can only be implemented through further Town Meeting Action
regarding zoning or other Town bylaws, or through votes of certain Town boards and commissions, after
advertised public hearings, for regulations adopted under the authority of those boards or commissions. Any
expenditures for capital facilities or other actions requiring new funding require further specific Town Meeting
approval of such expenditures or funding.
Recommendation: Finance Committee recommends approval.
29
