Article 37 <br /> To see if the Town will vote to transfer the care, custody, management and control of all or a portion of the <br /> Town land on which are currently located the Mashpee Fire and Police stations from the Board of Selectmen for <br /> general municipal purposes to the Board of Selectmen for the same general municipal purposes and also for the <br /> purpose of releasing whatever portion of said land the Selectmen deem appropriate for the purpose of settling the <br /> boundary line agreement with the owners of said abutting land separated from the Town land by Bates Road <br /> whereby some Town land may be released and some portion of the abutting land may be acquired by purchase, <br /> gift or eminent domain, as agreed upon between the Board of Selectmen and Mashpee Commons Limited <br /> Partnership and shown on a plan on file in the Town Clerk's office, or take any other action relating thereto. <br /> Explanation: This article seeks to approve a resolution to a boundary line problem as negotiated between the <br /> Board of Selectmen and Mashpee Commons Limited Partnership. <br /> Recommendation: Finance Committee recommends approval. <br /> Motion made by Nancy Caffyn. <br /> Motion: I move the Town vote to transfer the care, custody, management and control of all or a portion of the <br /> Town land on which are currently located the Mashpee Fire and Police stations from the Board of Selectmen for <br /> general municipal purposes to the Board of Selectmen for the same general municipal purposes and also for the <br /> purpose of releasing whatever portion of said land the Selectmen deem appropriate for the purpose of settling the <br /> boundary line between the said parcel of Town land and the abutting land separated from the Town land by Bates <br /> Road, and to authorize the Selectmen to enter into a boundary line agreement with the owners of said abutting <br /> land separated from the Town land by Bates Road whereby some Town land may be released and some portion <br /> of the abutting land may be acquired by purchase, gift or eminent domain, as agreed upon between the Board of <br /> Selectmen and Mashpee Commons Limited Partnership and shown on a plan on file in the Town Clerk's office. <br /> Motion passes at 7:55 p.m. <br /> Article 38 <br /> To see if the Town will vote to authorize the Board of Selectmen to transfer (a) parcel(s) of land consisting of <br /> 30,732 square feet more or less and located on Mashpee Assessors Map 61, Block 66, for no consideration to <br /> Habitat for Humanity of Cape Cod, Inc., for the construction on such land of a house for sale to a person of low <br /> or very low income within the meaning of the Housing Act of 1937, subject to existing zoning restrictions and <br /> building and health codes; provided that in the selection of the purchaser of such house, priority shall be given to <br /> a person whose residence or place of employment is in the Town of Mashpee; such sale to be made subject to a <br /> deed restriction in substantially the following form for a period of 20 years from the date of the first transfer by <br /> the Town pursuant to this Article: <br /> Whenever the owner shall desire to sell or otherwise transfer ownership or possession of the premises, the owner <br /> shall send a written Notice to the Town of Mashpee setting forth in detail the terms on which the owner desires <br /> to sell or transfer the premises. The Notice shall set forth the aggregate present value of all consideration and <br /> payments to be paid by the transferee for the premises (the "Selling Price"). The Town shall have the right <br /> within thirty days after receipt of such notice to buy, or designate a buyer for, the premises at the Selling Price, <br /> less the Land Value, which shall be the assessed value of the Land for real estate tax purposes at the time of such <br /> 44 <br />
