If the Town chooses not to buy, or designate a buyer for, the premises, it shall grant a <br /> release in writing allowing the owner to transfer the premises free of the restriction set forth in this ¶1. <br /> Upon the sale or other transfer of ownership or possession of the premises within twenty years after the date of <br /> this deed, other than to the Town pursuant to ¶1 above, the owner shall pay to the Town the Land Value; <br /> and further, vote to authorize the Board of Selectmen to petition the General Court for special legislation <br /> authorizing such transfer and restriction, and to make use of other agencies and instrumentalities of the Town, <br /> including but not limited to the Town of Mashpee Housing Authority, to effect the transfer of such land in <br /> accordance with this Article, or take any other action relating thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article authorizes the transfer of a house lot to "Habitat for Humanity" to construct one (1) <br /> single family home for a low to moderate income family. <br /> Recommendation: Finance Committee recommends approval. <br /> Motion made by George Costa. <br /> Motion: I move Article 38 be voted as printed in the warrant, with the exception of the phrase, "or take any <br /> other action relating thereto." <br /> Motion passes unanimously at 7:56 p.m. <br /> Article 39 <br /> To see if the Town will vote to amend the Zoning Bylaw by adding the following new Subsection 174-25 H. (8) <br /> to the Table of Use Regulations: <br /> "(8) Parking lot which is not accessory to another principal use on the same lot, subject to special permit <br /> approval by the Planning Board." <br /> And to indicate that such use is allowed by special permit in the C-1, C-1-0, C-1-SV, C-2 and I-1 districts by <br /> adding the letters "SP" in the Table of Use Regulations under those columns, while leaving the R-3 and R-5 <br /> columns blank to indicate that such use is not allowed in those residential districts, or take any other action <br /> related thereto. <br /> Submitted by Petition <br /> Explanation: Whether or not parking lots are allowed on lots separate from those on which there is a principal <br /> use requiring parking is not currently clear in the zoning bylaw. This amendment would specify that they are <br /> allowed, by special permit from the Planning Board, in commercial and industrial zones but are not allowed in <br /> residential zones. <br /> Motion made by F.
