Notwithstanding the provisions of subsection A, within any year the number of <br /> new dwelling units for which building permits may be issued shall not exceed 60 <br /> (sixty), plus any uncompleted dwelling units for which building permits have been <br /> issued and have not expired by, December 31 of the previous year. <br /> Submitted by Petition <br /> Recommendation: Planning Board does not recommend approval. <br /> Motion made by Thomas Analetto: To ensure that the issuance of building permits for <br /> residential development occurs in an orderly and predictable fashion so that the Town of <br /> Mashpee can: 1) guard against large variations in growth rates which adversely affect the <br /> town's environmental resources, economy and land values; 2) have time to plan effectively <br /> by studying the effects of residential growth on the town's character, natural resources <br /> and natural environment. <br /> § 174-26 Growth Management: <br /> B. Development Phasing. <br /> Within any year, building permits may be issued for new dwellings on no more than <br /> 15% (fifteen percent) of the lots in any subdivision approved by the Mashpee Planning <br /> Board under the Massachusetts Subdivision Control Law (the most recent such plan <br /> applicable to the lot shall apply), or 15% (fifteen percent), but at least one (1) of the <br /> lots shown on a plan of land not requiring subdivision approval recorded after May 11, <br /> 1987, or 15% (fifteen percent) of the approved dwelling units in any other type of <br /> residential or mixed-use development under a special permit. In the case of fractional <br /> numbers greater than 1/2 (one-half), the number of permits issued may be rounded <br /> upward. <br /> C. Building Permit Limits. <br /> Notwithstanding the provisions of subsection A, within any year the number of new <br /> dwelling units for which building permits may be issued shall not exceed 60 (sixty), plus <br /> any uncompleted dwelling units for which building permits have been issued and have not <br /> expired by, December 31 of the previous year. <br /> Recommendation: Planning Board does not recommend approval. <br /> Motion made to amend to not less than 60 and not more than 100 at 8:16 p.m. <br /> Motion to amend defeated. <br />
