construction/demolition materials and other difficult to manage waste at the Bourne <br /> Regional Waste Management Facility, or take any other action relating thereto. <br /> Submitted by the Board of Selectmen <br /> and the Board of Health <br /> Explanation: This article seeks to authorize an agreement with the Town of Bourne <br /> wherein Bourne will accept our difficult to manage waste which SEMASS cannot accept. <br /> Such items as mattresses, C&D, bulky furniture, street sweepings, etc. will be delivered to <br /> the Bourne facility. The proposed terms are as follows: tipping fee will be $45/ton in FY <br /> '99 and will increase to $47.74/ton in FY '01. The three-year contract may be extended <br /> for another two years if the Town so chooses. The tipping fee at Bourne for the fourth <br /> and fifth years would be $49.17 and $50.65/ton. Bourne has the only DEP approved lined <br /> commercial landfill in the immediate vicinity. <br /> Motion made by Selectman Leveille. <br /> Motion: I move the Town vote to authorize the Board of Selectmen, pursuant to General <br /> Laws Chapter 40, Section 4A, or otherwise, to execute an Intermunicipal Agreement with <br /> a term of up to five years with the Town of Bourne for the disposal of <br /> construction/demolition materials and other difficult to manage waste at the Bourne <br /> Regional Waste Management Facility. <br /> Recommendation: Finance Committee recommends approval. <br /> Motion passes unanimously at 7:59 p.m. <br /> ARTICLE 37 <br /> To ensure that the issuance of building permits for residential development occurs in an <br /> orderly and predictable fashion so that the Town of Mashpee can: 1) guard against large <br /> variations in growth rates which adversely affect the town's environmental resources, <br /> economy and land values; 2) have time to plan effectively by studying the effects of <br /> residential growth on the town's character, natural resources and natural environment. <br /> § 174-26 Growth Management: <br /> A. Development Phasing. <br /> Within any year, building permits may be issued for new dwellings on no more than <br /> 15% (fifteen percent) of the lots in any subdivision approved by the Mashpee Planning <br /> Board under the Massachusetts Subdivision Control Law (the most recent such plan <br /> applicable to the lot shall apply), or 15% (fifteen percent), but at least one (1) of the <br /> lots shown on a plan of land not requiring subdivision approval recorded after May 11, <br /> 1987, or 15% (fifteen percent) of the approved dwelling units in any other type of <br /> residential or mixed-use development under a special permit. In the case of fractional <br /> numbers greater than 1/2 (one-half), the number of permits issued may be rounded <br />
