19,730 sq. ft. and being more particularly described on a plan entitled "Plan of Land for Garry T. <br /> Melia in Mashpee, Massachusetts" dated November 13, 1997, by Christopher Costa & <br /> Associates, recorded at the Barnstable Registry in Plan Book 538, Page 83, and Block 52 <br /> containing approximately 1.2 acres and described in a deed recorded at the Barnstable Registry in <br /> Book 11520, Page 26; and further, to see if the Town will vote to raise and appropriate, borrow <br /> or transfer from available funds $255,000 for such purpose, including expenses incidental and <br /> related thereto, and that to raise such appropriation, the Treasurer, with the approval of the <br /> Selectmen, be authorized to borrow $255,000 or any other sum under and pursuant to Chapter <br /> 44, Sections 7 and 8C of the General laws or any other enabling authority, and to issue bonds or <br /> notes of the Town therefor; and further, to see if the Town will vote to raise and appropriate or <br /> transfer from available funds $1000 to the Issuance of Debt Account; and further, to authorize the <br /> Board of Selectmen to enter into contracts or agreements with federal and/or state agencies and <br /> other public or private entities or persons in connection with such purchase, to authorize the <br /> Board of Selectmen to petition the General Court for any special legislation convenient or <br /> necessary for such acquisition or the financing thereof and to authorize the Board of Selectmen to <br /> execute any and all instruments as may be necessary on behalf of the Town to effectuate said <br /> acquisition; or take any other action relating thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article authorizes and provides funding for the acquisition of two parcels of <br /> commercially zoned land located between the Town Hall and Main Street(Route 130). <br /> Recommendation: The Finance Committee recommends approval. <br /> Motion made by David Leveille. <br /> Motion: I move that (i) the Board of Selectmen be and hereby is authorized to acquire, by <br /> purchase or otherwise, for general municipal purposes, two parcels of land bounded generally by <br /> Great Neck Road North, Main Street (Route 130), the Cape Cod Coffee parcel and the Town <br /> Hall parcel as shown on the 1998 Mashpee Assessors' Maps as Map 36, Blocks 15 and 52, with <br /> Block 15 containing 19,730 square feet and being more particularly described on a plan entitled <br /> "Plan of Land for Garry T. Melia in Mashpee, Massachusetts" dated November 13, 1997, by <br /> Christopher Costa & Associates, recorded at the Barnstable Registry in Plan Book 538, Page 83, <br /> and Block 52 containing approximately 1.2 acres and described in a deed recorded at the <br /> Barnstable Registry in Book 11520, Page 26; (ii) the sum of$255,000 is hereby appropriated by <br /> the Town for the purpose of paying for the acquisition of said land, and for the payment of all <br /> other costs incidental and related thereto and that to meet this appropriation, the Town Treasurer, <br /> with the approval of the Board of Selectmen is hereby authorized to borrow said sum under and <br /> pursuant to Chapter 44, Section 7 of the Massachusetts General Laws, or any other enabling <br /> authority, and to issue bonds or notes of the Town therefor; (iii) the additional sum of$1,000 is <br /> hereby appropriated from Revenue Available for Appropriation to the Issuance of Debt Account; <br /> (iv) the Board of Selectmen is hereby authorized to enter into all contracts and agreements with <br /> federal or state agencies and other private or public entities or persons in connection with the <br /> acquisition of the land described herein; (v) the Board of Selectmen is hereby authorized to <br /> Page 15 of 63 <br />
