a plan entitled "Topographic Plan of Land in Mashpee, Massachusetts for Belcher Realty Trust" <br /> dated January 5, 1998, revised January 12, 1998, by Baxter &Nye, Inc., a copy of which is on file <br /> in the office of the Town Clerk; (ii) the sum of$9,410,000 is hereby appropriated to pay the costs <br /> of acquiring the aforementioned land and for the purpose of constructing a municipal golf course <br /> and recreational area on said land and for the payment of all other expenses incidental and related <br /> thereto, and that to meet this appropriation, the Town Treasurer, with the approval of the Board <br /> of Selectmen, is hereby authorized to borrow said sum under and pursuant to Chapter 44, Section <br /> 7 of the Massachusetts General Laws, or any other enabling authority, and to issue bonds or notes <br /> of the Town therefore; (iii) that the Board of Selectmen and all other Town boards are hereby <br /> authorized to apply for and accept federal and/or state grants for the purposes stated in this vote, <br /> including reimbursement under Chapter 132A, Section 11 of the Massachusetts General Laws, the <br /> "Self-Help Act" and / or Chapter 933 of the Acts of 1977, as amended, the "Urban Self-Help <br /> Act", and any other such enabling authority; (iv) the Board of Selectmen is hereby authorized to <br /> enter into contracts or agreements with federal and/or state agencies and other public or private <br /> entities or persons in connection with he purchase of the land described in this vote; (v) the Board <br /> of Selectmen is hereby authorized to petition the General Court for any legislation necessary or <br /> convenient for the acquisition of the land described in this vote or in connection with the financing <br /> thereof, and that (vi) the Board of Selectmen and all other Town boards are each authorized to <br /> execute any and all instruments as may be necessary on behalf of the Town to complete the <br /> acquisition of the land described in this vote. <br /> Motion to amend made by Francis LeBaron. <br /> Article 21 Amendment Motion <br /> Motion: I move that (i) the Board of Selectmen be and hereby is authorized to acquire by <br /> purchase or otherwise, for active recreation, conservation, passive recreation and/or other <br /> municipal purposes, all or a portion of a certain parcel of land known as the `Belcher" or "Mingo" <br /> property, bounded generally by Great Neck Road North, Ashers Path, Lowell Road, the Quashnet <br /> Valley Country Club, Phinney's Road and William Mingo Road and shown on the 1998 Mashpee <br /> Assesors' Maps as Map 44, Blocks 45, 46 and 58 through 84, inclusive, Map 51, Block 3 and <br /> Map 52, Blocks 40 through 60, inclusive, and more particularly described as Parcels 1, 2 and 3 on <br /> a plan entitled "Topographic Plan of Land in Mashpee, Massachusetts for Belcher Realty Trust" <br /> dated January 5, 1998, revised January 12, 1998, by Baxter & Nye, Inc. a copy of which is on file <br /> in the office of the Town Clerk; (ii) the sum of$2,300,000 is hereby appropriated to pay the costs <br /> of acquiring the aforementioned land and for the payment of all other expenses incidental and <br /> related thereto, and that to meet this appropriation, the Town Treasurer, with the approval of the <br /> Board of Selectmen, is hereby authorized to borrow said sum under and pursuant to Chapter 44, <br /> Section 7 of the Massachusetts General Laws, or any other enabling authority, and to issue bonds <br /> or notes of the Town therefor; (iii) that the Board of Selectmen and all other Town boards are <br /> hereby authorized to apply for and accept federal and/or state grants for the purposes stated in <br /> this vote, including reimbursement under Chapter 132A, Sectionl 1 of the Massachusetts General <br /> Laws, the "Self-Help Act" and/or Chapter 933 of the Acts of 1977, as amended, the "Urban Self- <br /> Help Act", and any other such enabling authority; (iv) the Board of Selectmen is hereby <br /> authorized to enter into contracts or agreements with federal and/or state agencies and other <br /> Page 18 of 63 <br />
