Matt Creighton from BSC Group and John Falacci from Bayswater Development presented <br /> plans. <br /> Agent said there was a lot of discussion regarding this area based on its form and the State's <br /> definition of coastal dune. It doesn't serve any function as far as storm damage prevention <br /> and there's not much in terms of wildlife habitat either. The Agent said that Matt Creighton <br /> had good documentation agreed this area doesn't really serve any function. The Agent felt it <br /> was very important to have all that information vetted out beforehand. They are also <br /> requesting a waiver of the requirement for the establishment of a 50ft wide undisturbed <br /> naturally vegetative buffer strip. All of proposed development is outside 50ft setback of top of <br /> coastal bank. They are asking for this waiver to continue the nourishment, which the Agent <br /> believes is very important and required. You can't prohibit the nourishment in order to <br /> establish the 50ft buffer. I suggest if you make a motion to approve, you make it known that <br /> you are approving this waiver. <br /> Another point is that beach nourishment obligation be explained in laymen's terms to whoever <br /> buys this property. <br /> John Falacci stated that the approval and the beach nourishment obligation will be conveyed <br /> to the buyer. It's part of the HOA. <br /> Mr. Sweet said he was curious when they will run out of access to the beach for nourishment <br /> purposes. <br /> Mr. Falacci said they won't because there is a 20ft way in the back of the proprerties that will <br /> not be impacted. <br /> Agent said if there are any other details to be provided in the landscaping/hardscaping of this <br /> property, we expect that to be submitted in a revised plan if this project is approved. <br /> John Falacci said yes, they would be back with a plan showing every detail of landscape and <br /> hardscape. <br /> Mr. Sweet asked if there was a HOA in place, John Falacci said yes, there is. The buyer <br /> already owns an existing lot and is familiar with it. <br /> Ms. Cadoret read comments from the Board of Health. <br /> Motion: Mr. Sweet moved to close and issue with the understanding there is a waiver of <br /> the 50ft buffer strip, Mr. O'Neil seconded. <br /> Vote: 6-0 unanimous <br /> 6:09 Carol A. Any replacement of <br /> disturbed lawn areas must meet Chapter 172 lawn standards.
