Bernhardt II & Allison B. Bernhardt, 37 Birch Way. Proposed addition to NOI
existing dwelling, detached garage, septic system relocation, hardscape/landscape
modifications and mitigation plantings.
Bradley Bertolo from JC Engineering presented plans.
Agent asked if the delineation of inland bank was in accordance with local Chapter 172 bylaw
or the State?
Brad Bertolo said the local bylaw.
Agent said Regulation 3 requires staking to be in place to show where structures are
proposed, which needs to be done. Also, Mashpee's Nitrogen Control bylaw prohibits new
lawn areas within 50ft of the top of the inland bank.
Mr. Sweet asked about a plant list, Brad Bertolo said that they didn't specify a species. They
felt it was more appropriate to work with the Agent regarding what's available at the time the
planting is to occur, but we would propose native plantings. Agent said his take on it is that it's
fine to determine the mitigation at the time of planting, but typically we see a species list in a
plan. It's not a problem to condition that along with the lawn issue and that staking be put in.
From a standards prospective, performance standards have been met.
Mr. Colombo asked that the motion be conditioned with a timeframe of 7 days for the staking
to be done.
Motion made by Mr. Sweet to close and issue with the conditions discussed.
Motion seconded by Mr. Dalton.
Vote: 5-0-0
Roll Call Vote:
Mr. Sweet, yes
Mr. Weeden, yes
Mr. Dalton, yes
Mr. O'Neill, yes
Mr. Colombo, yes
In favor, 5; Opposed, 0; Abstentions, 0
