MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> Owner, Arthur Burdick <br /> 47 Quaker Run Road and 7 Brown Terrace <br /> (Map 90 Parcel 43) <br /> Mashpee, MA 02649 <br /> V-2021-40 <br /> Mr. Furbush wanted to make sure there was no living space above the garage. Ms. Abare <br /> said there will not be any living space,but it will have electricity. <br /> Sharon read the Conservation Department and the Board of Health comments into the <br /> record. <br /> There were no more comments from the Board. <br /> GENERAL CRITERIA <br /> The subject property located at 47 Quaker Run Road and 7 Brown Terrace is approximately <br /> 14,560 square feet. <br /> There were no abutters present. <br /> VARIANCE CRITERIA <br /> Chapter 40A: Section 10. Variances: <br /> The authority specifically finds that owing to circumstances relating to the soil conditions, <br /> shape, or topography of such land or structures and especially affecting such land or <br /> structures but not affecting generally the zoning district in which it is located, 1) a literal <br /> enforcement of the provisions of the ordinance or by-law would involve substantial <br /> hardship, financial or otherwise, to the petitioner or appellant, and that 2) desirable relief <br /> may be granted without substantial detriment to the public good and without nullifying or <br /> substantially derogating from the intent or purpose of such ordinance or by-law. <br /> VARIANCE FINDINGS <br /> The Board determined the following; <br /> • The proposed garage site plan can be revised to meet the 15 ft. setback from the <br /> rear lot line. <br /> • The lot is odd shaped and is considered a hardship. <br /> • The proposed garage will not be substantially more detrimental to the <br /> neighborhood. <br /> • There is adequate land area to provide sufficient parking and setbacks as may be <br /> required. <br /> 2 <br />
