Not sure if they will need an updated environmental impact report. DA takes <br /> places of the DRI process. <br /> Mr. Gottlieb wanted more clarity, you don't know if it triggers, and if so, which filing threshold for MEPA. <br /> You only involve an EIR if one is otherwise triggered by MEPA, but your process doesn't trigger one by <br /> itself? <br /> Mr. Weeden explained under the DRI process most projects are subject to MA Historical Review. With <br /> a project of this size between two of our rivers, will that step be implemented somewhere along the <br /> way? He would feel more comfortable if it was necessary and it did require this study because it is such <br /> a sizable development. We all need to do our due diligence in all levels and aspects, environmental and <br /> historical planning ahead of when the CCC performs them, early on is the best approach in finding <br /> ways to mitigate properly. Our local health comprehensive plan from 1998 is inconsistence with home <br /> rule and local authority, so how are we adhering to the regional policy when our local comprehensive <br /> plan is not consistent with current revised 2018 RPP and all of its technical bulletins? <br /> Ms. Senatori said goals of the RPP, looking at that type of review, would be a component of the DA <br /> process. Mashpee does have a certified local comprehensive plan. Once an LCP is certified it should <br /> be considered to remain. Certifications of LCPs remain certified until deemed not. Process will <br /> adequately review proposal in light of LCP. <br /> Mr. Balzarini noted that right now Mashpee Commons has a special permit, before we go on with the <br /> DA, don't we have to rescind those permits to start new or fresh? <br /> Ms. Senatori wants to avoid commenting on local process. The Development Agreement itself could <br /> encapsulate the comprehensive nature of a development. <br /> Mr. Phelan informed members the LCP is currently under review, and will it impact this project? After <br /> this gains approval from the CCC and the Town does the Planning Board and Selectmen have any role <br /> in what transpires after that? <br /> Ms. Senatori doesn't not think it will have an impact. That is part of the yet to be defined. The DA <br /> negotiating and phases aren't fully defined, this is an opportunity for input into the DA. <br /> Ms. Waygan wanted to note if the zoning bylaw is approved that's by right, no one has any impact, if <br /> you do special permit then you will have future involvements. <br /> Mr. Balzarini asked if Mashpee Commons is going to stay the 25 years. Will they sell off the lots and <br /> once they sell off they have, once zoning gets changed, and we have to deal with individual <br /> developers? He is worried about having multiple developers. <br /> Mr. Phelan chimed in asking if he is talking about ownership. <br /> 8 <br />
