Meika Escher,who is Michael Escher's wife and business partner at DirtWorks., introduced herself <br /> for the record. She indicated that she had applied for the permit online, and contacted the <br /> engineer's office to complete their piece of the application. The engineer showed up on the site <br /> with an as-built card, and told the excavator it was not necessary to contact the Board of Health, <br /> because he was doing the inspection. The engineer had listed the application number on the as- <br /> built card where the permit number was supposed to be listed. Mrs. Escher stated that,when an <br /> engineer says everything is all set, you can typically trust them, but she will know better going <br /> forward.- She indicated that they had not worked with this engineer before, and had walked onto <br /> to job that was already in progress. <br /> Mr. Harrington commented that there have been no issues with this installer priorto this instance, <br /> and he was of the opinion that a warning was appropriate. Mr. Virgilio went on record as stating <br /> that he did not believe in giving people multiple warnings, and advised Mrs. Escher not to expect <br /> a break if there is another violation in the future. <br /> Mrs. Escher asked if the permit application could be updated,so she could pay the permit fit and <br /> the get a Certificate of Compliance. Mr. Harrington stated that he would apply the fee for <br /> payment and finish the process once that was paid. <br /> There being no further comments or discussion, Ernest Virgilio moved to issue a verbal warning <br /> in the matter of Michael Escher and 83 Troon Way. Motion seconded by Brian Baumgaertel. Roll <br /> call vote: Ernest Virgilio,(yes); Brian Baumgaertel (yes). VOTE: Unanimous (2-0). <br /> 4. Review of tobacco violations — Commons Convenience, 414 Nathan Ellis Highway. Mr. <br /> Harrington requested additional time to put together supporting information on this matter. He <br /> stated also that he had wanted Bob Collett to participate, but Mr. Collett is currently on vacation. <br /> Mr. Collett would have first-hand knowledge of current and previous violations at this <br /> establishment. <br /> The owner of Commons Convenience and his attorney were dialed-in to the meeting, but Chair <br /> Baumgaertel agreed it was important to have Mr. Collett at the meeting, and both he and Mr. <br /> Virgilio were in favor of a continuance. Mr. Harrington stated that he was in communication with <br /> Attorney Wall, and would provide him with a copy of all the pertinent documents once they had <br /> been compiled. <br /> There being no further comments or discussion., Ernest Virgilio moved to continue the matter of <br /> the tobacco violations at Commons Convenience,, 414 Nathan Ellis Highway,to the next meeting <br /> scheduled for January 21., 2020. Motion seconded by Brian Baumgaertel. Roll call vote: Ernest <br /> Virgilio (yes); Brian Baumgaertel (yes). VOTE: Unanimous (2-0). <br /> 5. Review and approval of Nitrogen Aggregation Plan —Peter McEntee, 12 Leeshore Drive. Peter <br /> McEntee,of Engineering Works,introduced himself forthe record as representing the prospective <br /> buyer of the vacant lot at 12 Leeshore Drive,which is in a Zone 11. He stated that the lot is 14,452 <br /> SF and the design is for a three-bedroom dwelling. The open space area in the Seabrook Village <br /> subdivision is to be used as credit land for the undersized property to obtain the additional land <br /> needed for three bedrooms. In this case., 16,120 SF of credit land is needed. Mr. McEntee stated <br /> that he had provided the credit land survey plan and Grants of Title V Nitrogen Loading Restriction <br /> and Easement for the facility and credit land. <br />
