Mr. Harrington commented that Seabrook village has offered several of the credit land areas from <br /> their open space to increase bedrooms on vacant lots that are remaining in the subdivision. The <br /> documents were reviewed with no issues encountered. The septic design plan was also submitted <br /> with this approval request, but a reserve area needs to be added and, because it is new <br /> construction.,the land surveyor should stamp all of the plans. <br /> There being no further comments or discussion, Ernest Virgilio moved to approve the Nitrogen <br /> Aggregation Plan for 12 Leeshore Drive with the following conditions: 1) the Grants of Title V <br /> Nitrogen Loading Restriction and Easement be finalized and recorded at the Registry of Deeds, <br /> with an executed stamped copy provided to the Board of Health prior to issuance of the septic <br /> installation permit and approval of the Building permit; and the survey plans of the credit land <br /> and the septic design plan must be stamped by a registered land surveyor prior to recording. <br /> Motion seconded by Brian Baumgaertel. VOTE.- Unanimous (2-0). <br /> Mr. Harrington commented that, at the last meeting on December 17, 2020, the Board voted to have a <br /> letter sent to the property owner regarding removal of the vehicles, and further voted that an inspection <br /> of property and the dwelling be performed. That letter was sent Certified Mail, and the inspection was <br /> performed on January 6 1h. David Weeden, Patricia Weeden's son, was at the site and accompanied the <br /> Health Agents around the property. A Sanitary Code Inspection Form was completed which documented <br /> 5 campers, 2 storage units, 8 vehicles, appliances, bicycles,trailers, metal, plastic and other refuse. Mr. <br /> Harrington estimated that approximately 20%of the property is covered by debris and, since it has been <br /> there many years, it is considered a harborage for pests. A shed behind the dwelling was also observed <br /> to be collapsed. <br /> The on-site dwelling was inspected from the exterior. Mr. Weeden explained that the propane delivery <br /> company would not deliver gas, as access to the propane storage tank was considered a hazard. Mr. <br /> Harrington noted that there is no heat in the dwelling. The condition of the dwelling is poor, as it has not <br /> been lived in for over 10 years. Each room has clutter on a hoarding scale of about a 5-6, where there <br /> was only a small passageway in each room. The northern section of the dwelling has a collapsing roof, <br /> interior walls and/or ceilings. <br /> Mr. Harrington stated that, as far as enforcement goes, fines started accruing on August 17, 2020, and <br /> approximately $750 in fines had accrued as of the September P meeting. Mr. Harrington had a <br /> conversation with Ron Turner, one of the owners, and he indicated that the vehicles were owned by his <br /> brother, Buzzy Turner,who refuses to release the titles. There is a legal question as to whether the owner <br /> can remove the vehicles from the property without the titles. Mr.Turner was advised to seek legal counsel <br /> on that matter. <br /> On November 5 th, Health Agents witnessed a trailer on the property being occupied,with some materials <br /> having been removed. Mr. Harrington stated that., per Mr. Weeden, the occupants of the on-site trailer <br /> have since moved to Wareham and are not occupying the trailer. Therefore,, no inspection was done on <br /> the trailer,though it remains on the property unoccupied. <br /> 5 <br />
