Ron Turner introduced himself for the record. He stated that he talks to his brother every day and wants <br /> to get the cars moved. Different cars were abandoned on the property at different times, but he guessed <br /> most of them had been there for 8-10 years. Mr.Turner said each time he talks to his brother,the brother <br /> tells him he has a plan for removing the debris and the vehicles. Mr. Turner did call a salvage company <br /> but they are not able to remove the vehicles without the titles. Chair Baumgaertel said there may be <br /> some recourse in abandoned property laws, and suggested that might be an avenue to explore. <br /> Chair Baumgaertel stated that, with the house not having heat and being in such a state of disrepair,and <br /> being a harborage for rodents, a condemnation order was definitely called for. Mr. Harrington reminded <br /> Board members that, per the Sanitary Code, the owners have a year to take corrective action after <br /> condemnation before the Town can step in. Board members agreed that everyone would like to avoid <br /> the Town having to perform the clean-up and put a lien on the property., but the issue has gone on far too <br /> long. <br /> Chair Baumgaertel was of the opinion that the vehicles are a separate issue from the debris. The vehicles <br /> were more of a priority, but would also take more time to resolve based on the title issues, and he did not <br /> want that to delay clean-up of the other debris. Chair Baumgaertel suggested a 90-day timeframe which, <br /> in his opinion, provided adequate time to pursue legal advice on the vehicles and adequate time to <br /> address the refuse. Mr. Virgilio agreed, but cautioned that accumulated snow could limit access to the <br /> property at any time, and the progress may be weather dependent. Chair Baumgaertel recommended <br /> that the Board review the matter in 90 days. The Board has given some leeway when progress has been <br /> demonstrated. If, after 90 days, there are extenuating circumstances, the deadline could be extended. <br /> At a minimum, a 90-day check was needed. Mr. Virgilio agreed. <br /> There being no further comments or discussion,, Ernest Virgilio moved to review the compliance status of <br /> the property at 73 Lovell's Lane in 90 days. Motion seconded by Brian Baumgaertel. Roll call vote: Ernest <br /> Virgilio (yes); Brian Baumgaertel (yes). VOTE: Unanimous (2-0). <br /> Chair Baumgaertel asked for a motion to condemn the property at 73 Lovell's Lane. <br /> There being no further comments or discussion, Ernest Virgilio moved to condemn the property at 73 <br /> Lovell's Lane based on evidence found during an inspection by a Health Agent,,which indicated numerous <br /> Sanitary Code violations that deem the property uninhabitable. Motion seconded by Brian Baumgaertel. <br /> Roll call vote: Ernest Virgilio (yes); Brian Baumgaertel (yes).
