overgrown. Mr. Harrington stated that he would check-in with the owner again this week. Ms. Warden
asked if the owner had been given a timeframe within which to correct the violations, and Mr. Harrington
answered in the affirmative. Chair Baumgaertel read the previous motion from the meeting on December
31 2020, relative to this matter. Ms. Warden expressed serious concerns about the rat population in the
vicinity of this property, particularly with spring coming. Mr. Harrington did not have the file with him,as
this matter was not on the agenda for discussion. Ms.Warden asked that, if the certified order letter had
not yet been sent, that it be done promptly due to the seriousness of the situation. Chair Baumgaertel
asked if there was any possibility of serving the letter directly to the residence, and Mr. Harrington stated
that the owner only comes down on weekends.
Chair Baumgaertel recommended that, if the matter is going to be discussed further and/or the Board is
going to render any kind of opinion, that the item be added to the agenda.
Veronica Warden moved to add the matter of 97 Sunset Strip to the agenda. Motion seconded by Ernest
Virgilio. Roll call vote: Ernest Virgilio (yes); Veronica Warden (yes); Brian Baumgaertel (yes). VOTE:
Unanimous (3-0).
Mr.Virgilio inquired if the owner had been notified that fines are accruing, and Mr. Harrington reiterated
that, without the file, he was notable to answer that question. He did confirm that the owner has called
several times to say she is working on cleaning up the property, and the Board typically does not take any
action if there is effort being made to correct the violations. Ms. Warden asked if anything has been
removed from the property, and Mr. Harrington stated that he had not been back to check. Ms. Warden
was of the opinion that the owner has had plenty of time to take action. Mr. Harrington reminded the
Board that, when fines are issued, they are allowed to accrue for 30 days before the Board can take a vote
to send the matter to Town Council.
Chair Baumgaertel stated that,, without verification that the order letter was sent to and received by the
property owner., proper notification cannot be confirmed and fines cannot accrue. He agreed it is
imperative that something be done, but notification requirements must be met.
Mr. Virgilio stated that he would prefer to have the information in front of him to review prior to
discussing the matter further. Chair Baumgaertel agreed that it is tough to have a discussion for which no
one was prepared. Ms.Warden asked Mr. Harrington to take some photos of the property,so the Board
could see the condition, and Chair Baumgaertel asked that the matter be included on the next meeting
agenda.
NEXT MEETING
The next meeting of the Board of Health was scheduled for Thursday,January 21, 2021 at 7:00 PM.
There being no further business, Ernie Virgilio moved to adjourn the Public Session Meeting of the Board
of Health at 8:30 PM.
