Town of Mash, ee <br /> ..............p <br /> ............................... ............... ............................. ................................................. ............................... <br /> "JI I <br /> 16 Great Neck Road North <br /> AA <br /> Mash pee, Massachusetts 02649 <br /> BOARD o f HEALTH P U B L I C SESSI ON <br /> Mashpee Town Hall —Waquoit Meeting Room <br /> Minutes of the Meeting of March 4, 2021 <br /> Board Members Present: Member Absent: Also Present. <br /> Brian Baumgaertel,Chair Glen Harrington, Health Agent <br /> Veronica Warden,,Vice-Chair <br /> Ernest Virgilio, Clerk <br /> Chair Brian Baumgaertel called the meeting to order at 7:02 PM, and stated for the record that Board <br /> members were participating remotely. <br /> OLD BUSINESS <br /> 1. Review of compliance—545 Cotuit Road. Mr. Harrington commented that, at the last meeting, <br /> the Board had asked him to confirm whether or not the property owner had applied to the <br /> Barnstable County Community Septic Management Loan Program. Mr. Harrington did confirm <br /> with Angela DoCarmo.,who assists with the program,that the owner had submitted an application <br /> but was denied,as the County could not provide funds for just the interior plumbing. The program <br /> was willing to loan funds for the entire septic repair.. but Indian Health Services had already agreed <br /> to pay for that. With regard to bringing the property into compliance, no additional information <br /> or updates have been provided since the last meeting. <br /> Ms.Warden asked why the septic loan program wouldn't consider the egress to be related to the <br /> septic, and Mr. Harrington answered that the loan program couldn't consider the interior <br /> alterations incidental to the septic repair, because they are not loaning the money to pay for the <br /> septic repair. Mr. Harrington stated that septic plans have been approved and a permit has been <br /> issued. Therefore,the system can be installed as soon as the installer,Joey Debarros,signs off on <br /> the contract with Indian Health Services. No building permit has been issued to bring the <br /> basement bedrooms into compliance. In response to a question from Mr. Virgilio about <br /> jurisdiction, Mr. Harrington explained that there are portions of the Sanitary Code that overlap <br /> the Building Code,and egress is one of those areas. There has to be proper egress from the living <br /> space and sleeping areas and, because it is structural,a building permit is required. <br /> Chair Baumgaertel stated that it was his understanding the owner wants to keep the basement <br /> bedrooms because they are providing shelter to other tribal members. Chair Baumgaertel felt it <br /> would be necessary., at some point, to order the bedrooms to be removed if sufficient progress <br /> isn't made. Mr.Harrington stated that the septic system is an imminent health hazard,and people <br /> living in the basement bedrooms without a means of proper egress is a life safety issue. We are <br /> attempting to get both matters corrected, but are not going to let one repair hold up the other, <br /> The owner is moving forward with the septic work,and just needs to apply for the building permit, <br /> so they can begin the interior alterations that will bring the basement bedrooms into compliance, <br /> 1 <br />
