EXECUTIVE SESSION MINTUES <br /> MASHPEE BOARD OF SEWER COMMISSIONERS <br /> MONDAY, JULY 26, 2021 <br /> WAQUOIT MEETING ROOM <br /> MASHPEE TOWN HALL <br /> 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> Present: Joe Lyons, Mike Rapacz, Ken Dunn, Al Towle, Tom Fudala, Anne Malone <br /> Public: Rodney Collins, Wayne Taylor, Chris Gallagher, Pat Costello, Jeff Gregg, Andy <br /> Gottlieb, Sandy Tripp, Anastasia Rudenko <br /> Mr. Towle motioned to go into Executive Session pursuant to MGL Chapter <br /> 30A, Section 21(a)(6): to consider the purchase, exchange, lease or value of <br /> real property. <br /> Mr. Dunn seconded the motion. <br /> Vote: 6-0-0 <br /> Roll Call Vote: <br /> Mr. Fudala; yes <br /> Mr. Lyons; yes <br /> Mr. Dunn; yes <br /> Mr. Rapacz; yes <br /> Ms. Malone; yes <br /> Mr. Towle; yes <br /> In favor, 6; Opposed, 0; Abstentions, 0 <br /> EXECUTIVE SESSION <br /> Pat Costello spoke with the Attorney Mulligan from Summerwood Condos, they have <br /> been speaking with Sea Oaks Condos as well. They want to be sure there's no <br /> difference between the two. We'd gain value of maybe +/- $100K, the easement will <br /> only be a utility access, no other public rights. It first benefits individual owners in <br /> Summerwood. How do we distinguish between mains and laterals? Why should <br /> taxpayers pay $1.5million for the mains? Attorney Mulligan understood and said <br /> Summerwood can't afford that level of expense. <br /> Any townsperson could sue the Town to say it isn't fair. Your (the Sewer Commission) <br /> point is it does provide public benefit. Our dilemma is are we to improve private <br /> primarily for the benefit of property owners, or are we benefitting the entire public <br /> interest? <br /> Mr. Fudala stated that the reason we said no betterments was cleaning out the <br /> estuaries, so we wouldn't have to tie in everyone in town, even though everyone <br /> contributes to the problem. Only a portion will get sewered, but all will benefit. <br />
