Pat Costello said that point is very clear, but we can't deny that we're enhancing the
value of individual property by providing sewer.
Mr. Fudala said that costs will increase, it's not really a financial benefit.
Pat Costello said property value in Mashpee with a sewer tie in is a much higher value
than with septic.
Andy Gottleib said if on a public sewer, you do not have to replace the septic systems.
So that's a value. Cap per property cost at"X" and anything over taxpayers cover, like
Barnstable did. Set up a metric applied to everyone and subsidize.
Pat Costello said from a legal analysis, the key concept is "disproportionate benefit". No
individual owner should receive disproportionate benefit.
Chris Gallagher said public money can go to the edge of the right of way. Anything on
private property takes on full cost of the project. Divide by people was poor planning.
Andy Gottlieb said if the Town puts this on SRF loan and charges them back on
betterment, allows them to spread cost over 30 years. Does that work?
Pat Costello said absolutely, that's typically how it's done. All we need is to be
reimbursed for the costs. 30 years limits the sting of this. Betterment is the best way.
Andy Gottlieb said quick math is roughly $100+/- per month on top of condo fee over
30 years. Did the Town Meeting vote authorize the assessment of betterments?
Mr. Fudala asked if betterments is the only logical way to do this.
Pat Costello said yes. In regards to the Town meeting, he said there was nothing about
betterments on the meeting.
Mr. Rapacz asked if it's that painful to ask for betterments in this situation.
Andy Gottlieb said the concern is adding that authority without having to revote.
Pat Costello said he doesn't think we'd have to revote.
Chris Gallagher said we had a district vote in the 80's to vote to authorize taking, did
authorize easement. We have to have title or access.
There was discussion about the SRF application and what could be added.
Mr. Fudala said it sounds like the preferred way to go is to take an easement.
Pat Costello said we have the right to take easements, no Town Meeting required.
Mr. Fudala asked Pat Costello to discuss this with Summerwood so they can talk to Sea
Oaks. We can do the same thing for them.
Pat Costello said we should contract all property in Phase 1 for betterments at the same
time.
Mr. Fudala said if we can get a consensus from the Commissioners tonight, and with
Andy Gottlieb's blessing, we could get started. Who determines the values?
Pat Costello said by law, it has to be an independent appraiser.
Mr. Fudala asked for a consensus vote that an appropriate approach to condominiums
is to take a utility easement for the sewer mains, and charge a betterment to reimburse
the costs to the Town over 30 years, and that is how we treat condos from now on, and
allow the Town Engineer to work with legal to provide him information
Every commissioner voted yes for a consensus to Mr. Fudala's suggestion.
