Mr.Niedzwiecki stated there is no time frame on this.Right now we are <br /> starting with discussions and introducing the process all three parties have to go through together. <br /> Lynne Barbee said she is confused about the process. Her understanding is that Mashpee Commons will <br /> first do the Development Agreement with the Commission,then go to the town to do zoning that would <br /> apply to that Agreement. Mr.Niedzwiecki confirmed this approach, and added that the zoning was <br /> considered early in the hopes that the Planning Board understood the project and could get this out of the <br /> way sooner. But when this did not happen,the process reverted to the Development Agreement process. <br /> Dennis Balzarini expressed concern for the status of the existing Chapter 40B project in light of the <br /> pending Development Agreement betweem the Commons and the Commission. He asked if the existing <br /> agreement is still effective. Mr.Niedzwiecki responded that there is no mandate to complete what is <br /> specified in a Ch.40B Comprehensive Permit. However, Chairman Isbitz thought this caused confusion <br /> between the ZBA comprehensive permit approval for 384 units,of which 96 were to be affordable, and <br /> state approvals given for the 52 unit project. Also, state and town resources were committed for <br /> infrastructure improvements in support of the 52-unit project that included 13 affordable units. This is a <br /> separate and distinct matter from the current Development Agreement with the Commission. <br /> Chairman Isbitz believes that the Commons has an obligation to the State and to the Town to complete <br /> the remaining 20 units of the 52-unit project in return for state and local resources committed to the <br /> project. Chairman Isbitz said he is not talking only about town funding. He is talking about funding from <br /> whatever source,including state commitments of rental subsidies, as well as road and utility work. To get <br /> state funding an affordable project needs,DHCD isn't going to give a substantial amount unless local <br /> area,the town and/or region contributes a sufficient amount of money to show the local area is committed <br /> to the project. It could be land, or density bonuses or per unit subsidy,but DHCH will not release$10 <br /> Million for a project, for example,unless they see money committed at the local level. Once the state <br /> makes this kind of commitment, it expects the local developer to act in good faith and complete the <br /> project.Therefore,Mashpee Commons should plan to complete the 52-unit project separately from the <br /> plans it is proposing under the Development Agreement with the Cape Cod Commission. <br /> Mr.Niedzwiecki stated the 40b comprehensive permit remains in effect.Market forces and other reasons <br /> such as we think we can do better with a larger project.That is what is being considered. <br /> Chairman Isbitz thanked Mr. Chace,Mr.Niedzwiecki,and Ms. Creamer for coming this evening and he <br /> thanked everyone for joining in person. <br /> Adjournment.
