MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
DULY 24,2019
Sharon read the DPW, Board of Health comments into the record. She also read abutter
comments into the record.
Charlie read his comments into the record and asked why the plans were not stamped by a
land surveyor to verify all setbacks, and that Wampanoag Ave is a street or public way.
Attorney Kirrane said that it is signed by a Civil Engineer. Charlie said that the setbacks
are not on the plans.
Mr. Ed Claremont a resident at Johns Pond Estates has concerns with traffic and the store
itself.
Mr. Walter Phillips, a resident at Johns Pond Estates requested that the Board--deny the
project for three reasons; traffic congestion, an excessive number of exemptions, and the
change in character of the neighborhood.
Mr. Keen, 57 James Circle agrees with Walter Phillips comments, and would like to see a
smaller building.
Anne, a resident at 209 James Circle is in opposition of the store. --
Jonathan is concerned about the traffic with this project. He asked if this hearing could be
continued, and to find out what the State is proposing for the area on Rte. 151.
Ron asked the applicant if there can be a low level traffic study done on the intersection of
Ninigret and Rte. 151. Jonathan wants to know what the State plans are. Ron said he
attended the meeting but they discussed the pedestrian traffic. There was some discussion
on traffic lights on Old Barnstable Road. Ron said that a traffic engineer could put strips
out and get information on daily trip counts on Rte. 151.
James Reiffarth would like to see how many people visit this type of store on a daily basis.
What is the average amount of vehicles?
Attorney Kirrane said he's not sure a traffic study will be meaningful. He will accept the
continuance and determine if this exercise is worth pursuing.
Scott Goldstein said as one member he has concerns with'the size of the building. He
doesn't believe the traffic has anything to do with the use and is irrelevant.
Ron made a motion to accept the applicant's request to extend both the Variance and
Special Permit requests until August 28,2019. Scott second. All were in favor.
i
16
