MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT (SP-2015-33) MODIFICATION <br /> Triple M Management Company, LLC, and <br /> Ronald Gangemi, Trustee of 81 Echo Road Realty Trust <br /> 29 &41 Echo Road (Map 19 Parcel 3-9) (Map 19 Parcel 3-8) <br /> Mashpee, MA 02649 <br /> SP-2019-36 <br /> SPECIFIC SPECIAL PERMIT FINDINGS: <br /> The Board heard testimony and engaged in a detailed discussion relative to the operation <br /> of the adult use (recreational) marijuana business relating to the parking, appointment <br /> scheduling, anticipated traffic flow, proposed traffic light, security measures, product <br /> distribution, and site maintenance. <br /> The applicant said that when the operation of the medical facility first commenced, it was <br /> handled by appointment only. The adult recreational facility will be by appointment only <br /> as well, and may phase out in the future depending upon the amount of customers and <br /> traffic flow. The applicant is anticipating approximately 400 cars per day, and currently <br /> witnesses 50 to 100 cars per day. The applicant will perform a traffic study with the <br /> Department of Public Works (DPW) to determine the available equipment and function <br /> options. There was discussion that the queuing lane located inside the fenced area is part <br /> of the traffic management system controlling the traffic flow and to avoid any congestion <br /> on Echo Road. <br /> There are currently three handicapped parking spaces situated on the medical side of the <br /> building. An additional handicapped space will be situated close to the building by the exit <br /> of the adult use(recreational)marijuana side of the building, and will also be handicapped <br /> parking situated within the employee parking area. There will be two separate entrances, <br /> one for the medical and one for the adult use section of the building. There will also be <br /> parking for anyone who has pre-ordered product. <br /> There will be no dumpster installed on the outside of the facility for safety purposes. The <br /> recreational product itself is delivered pre-packaged to the facility, and any disposal of <br /> waste is handled inside the building and serviced by a licensed hauler to avoid anyone from <br /> trespassing. The waste generated is mostly paper products or waste from the restrooms. <br /> The applicant said they will increase the amount of security guards and parking attendants <br /> when the adult use commences. The applicant will be applying for permitting with the State <br /> for the adult use, but will continue to operate the medical facility. The adult use cannot <br /> commence until the new building is completed, and the issuance of a Certificate of <br /> Occupancy by the Building Department. <br /> There was discussion regarding the host agreement that was established between the Town <br /> with the Board of Selectmen and the operator for a period of five years. Most towns enter <br /> into a host agreement, otherwise the State will not grant a license to operate. The host <br /> agreement was referenced and was amended on April 10, 2015, (paragraph 3) to include <br /> the traffic signal when the course of action to move to the adult use of marijuana. <br /> 4 <br />
