MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Petitioner, Bridgestone Development, Inc. <br /> (Owner of record: Faith J. Baptiste, Trustee of the <br /> Cushman Brownie Trust <br /> 9 Shellback Way (Map 81 Parcel 132) <br /> Mashpee, MA 02649 <br /> SP-2019-37 <br /> The Board heard from several abutters regarding the ownership of the lower portion <br /> of Shellback Way, and an abutter who has the same address as the proposed lot. There was <br /> a discussion with one resident that the road was built prior to the condominiums, and the <br /> address will need to be changed by the Town's GIS Coordinator. <br /> Associate Board Member, Sharon Sangeleer read an email letter dated August 28, <br /> 2019 submitted by Stephen Carroll, SVP-Director of Corporate Services of Rockland Trust <br /> into the record. <br /> Mr. Stephen Carroll, Rockland Trust approached the Board and said he met with <br /> the developer Mike Facchini after the July 24th hearings and said that they discussed the <br /> items that were read into the record. Jonathan agreed with his concerns regarding the <br /> construction vehicles going through the parking lot. Jonathan asked Matt when he will <br /> receive the State approval for the curb cut. Matt said it takes approximately three months, <br /> and could be longer depending upon the State's back log. Matt said that a vast majority of <br /> the construction vehicles will require access through the right turn in curb cut on Rte. 28, <br /> and the trucks might require using Shellback Way to exit if turning left onto Rte. 28. <br /> Attorney Kirrane said based on the discussions that his client had with the bank, <br /> they will address any concerns because they will be sharing that same access on that site. <br /> The Board requested Charles Rowley, Engineering Consultant to review and <br /> inspect the proposed site. Attorney Kirrane had seen Charlie Rowley's estimate that was <br /> read into the record; he had no issues. <br /> The Board read the Town Department comments into the record. There were no <br /> more comments by the Board or audience. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Special Permit. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday, August 28, 2019,the Zoning Board of Appeals voted unanimously to issue a <br /> Special Permit for 9 Shellback Way, Petitioner, Bridgestone Development, Inc. under <br /> §174-24, and §174-25 (D) (1) (2) to allow for construction of a 9,801 sq. ft. commercial <br /> building and accessory parking to be used for professional and medical office uses on <br /> property located in a C-1 Zoning District, (Map 81 Parcel 132), Mashpee, MA. (Owner of <br /> record: Faith J. Baptiste, Trustee of the Cushman Brownie Trust) with the following <br /> conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 3 <br />
