MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> SEPTEMBER 11,2019 <br /> 19 Keel Way: Owner, Julieann E. Rainville, Trustee requests a Variance from §174-33 <br /> (setbacks from water and wetlands) of the Zoning Bylaws to allow for construction of a <br /> shed on property located in an R-3 Zoning District, and Little Neck Bay, Map 120 Parcel <br /> 138, Mashpee, MA. <br /> Mr. Wayne Tavares represented the homeowner for the shed. He said that he was in front <br /> of the Board a few months ago for a similar proj ect that the Town has a setback requirement <br /> for structures within 50 ft. of wetlands. This shed meets all building code requirements, <br /> and lot coverage has currently 23.76%coverage, and shed only is seven tenths of a percent. <br /> The shed size is 10' x 12', and is 25.5 ft. away from the top of the coastal bank. It is a <br /> portable structure, and is not fixed to the ground. An order of conditions was issued from <br /> the Conservation Commission. The shed will be located 5 ft. from the property line. The <br /> applicant said he is requesting 25 ft. from the coastal bank. <br /> Sharon read the Conservation and Board of Health comments into the record. The Board <br /> confirmed the size of the shed as 10 ft. x 12 ft. <br /> There were no comments from the audience. <br /> Mr.Bonvie made a motion that the Board issue a Variance to Julieann E.Rainville Trustee <br /> from §174-33 (setbacks from water and wetlands) of the Zoning Bylaws to allow for <br /> construction of a shed on property located in an R-3 Zoning District, and Little Neck Bay, <br /> Map 120 Parcel 138, Mashpee, MA, with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Variance <br /> under Mass General Law 40A Section 10. <br /> 2. A Landscape Development Plan for: Julieann Rainville, 19 Keel Way, Mashpee, <br /> MA, Proposed Conditions Relocated Deck, Planting & Mitigation, Provided by: <br /> Wet Tech Land Design, Inc., Scale: 1" = 20', Drawn by: Wayne Tavares L.A., <br /> Date: 2/27/2019, Checked: WRT, Job No.: 19-1600. Revised FEMA Changes: <br /> 3/17/2019. <br /> 3. The Board issues a Variance in the amount of. 25 ft. Calculated as 50 ft. required, <br /> the plan shows 25ft, thus 25 ft. is required. <br /> 4. Conditioned on all Town Department comments read into the record. <br /> 5. No heat or habitation allowed in this shed. <br /> 6. The applicant has received an Order of Conditions from the Conservation <br /> Commission. <br /> 3 <br />
