MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> OCTOBER 16,2019 <br /> There were no more questions from the Board. <br /> Jonathan read a memo into the record from Evan Lehrer,Town Planner dated October 10, <br /> 2019. <br /> Scott read a memo into the record from the Plan Review Committee dated October 3,2019. <br /> Jonathan asked Rob about the private road issues with the association that was mentioned <br /> by the DPW Director. Rob said he was unclear what was discussed. Charlie said that the <br /> road is private, and the concern is whether the road is being maintained properly.Ron said <br /> as one member, that these. comments are just recommendations to the Zoning Board. <br /> Jonathan polled the Board asking if they agree that these comments are not under the <br /> Zoning Board's prevue. They all agreed. <br /> Jonathan asked Charlie about the sprinkler system question. Charlie said that he will be <br /> meeting with the applicants, and subsequent meetings to look at the actual system, and <br /> determine whether a section of the building needs sprinklers or if the whole building needs <br /> sprinklers. Charlie said;those are code issues and has nothing to do with the zoning. Scott <br /> asked if the State CCC requires any sprinkler systems for this type of equipment. Greg said <br /> that this is a meeting with the Fire Department, and Charlie to review. <br /> Jonathan asked for comments from the audience. Lisa and Dean Beachy own Budget <br /> Blinds and have no issues and supports the application. Shanon Defrancisco, a resident <br /> asked what the extraction process is. Rob said that the extraction is the essential oil of the <br /> plant. There are cannabinoids,terpenes, and flavonoids are part of the extraction process. <br /> Ron asked the applicant if the State would delay or deny the issuance of a modification to <br /> an existing special permit because the advertisement was not published as a modification. <br /> The applicants said they only stated they need the Town's approval. <br /> Charlie said that the original special permit was issued by the ZBA permitting authority <br /> and in his opinion should be a modification of the original special permit.The Board agreed <br /> to his statement. <br /> Ron made a motion to issue a modification to an existing special permit SP-85-03-010 <br /> under Kevin P. Andrade Trustee of Summerfield Realty Park.The modification is to allow <br /> the inclusion of a marijuana manufacturing facility at 800 Falmouth Road Unit 101 C under <br /> a Special Permit under §174-25 E (16) (Table of Use Regulations), and §174-24.K of the <br /> Zoning Bylaws to allow for a marijuana manufacturing facility.located in an I-1 Zoning <br /> District(Map 88 Parcel 2), Mashpee, MA(Owner of Record: Kevin P. Andrade, Trustee <br /> of Summerfield Park Realty Trust). <br /> 4 <br />
