Ms. <br /> Willander advised the Board that the Fanny Mae holds the mortgage on the property, and had <br /> reached out for a status update after learning that the owner had passed away. <br /> Mr. Harrington reported that, in this case,where there is a family member involved and willing to <br /> take responsibility for the clean-up, he is of the opinion that the Board should give the brother <br /> the opportunity to get it done. Mr. Harrington asked the Board's support in checking in with the <br /> brother every 30 days and, if necessary, consider further action after January 1, 2022, if no <br /> progress has been made. <br /> There being no further comments or discussion, Ernest Virgilio moved that Health Agents should <br /> re-visit the status of sanitary conditions at 135 Scituate Road every 30 days, and bring the matter <br /> back before the Board afterJanuary 1st for further consideration and possible enforcement action, <br /> unless the Board needs to take action prior to that. Request to Waive Title V Inspection Feeā€”Santuit Pond Abutters. Mr. Harrington commented <br /> that the Board voted to order septic inspections and pumping for over 100 abutters whose <br /> properties fall within 300' of Santuit Pond. Order letters were sent via First Class and Certified <br /> Mail on September 9th. Since then, we realized that we cannot enforce the 4' separation to GW <br /> required in our Septic Inspection Regulation because that provision only applies to inspections <br /> that are performed for property transfer purposes. A system that would otherwise fail due to not <br /> having the 4' separation to GW required by our regulation would, for purposes of this order, be <br /> considered a pass (unless it failed under some other criteria). Additionally, properties that are <br /> serviced by a potable well are not being required to sample their water as part of the inspection <br /> process. Therefore, inspectors have been advised that all reports should indicate"This Inspection <br /> is Not Valid for Property Transfer Purposes." We've been asked to waive the submittal fee due to <br /> this being a Board of Health Order, and the fact that these inspections are not valid for property <br /> transfer purposes. Property owners have the ability to appeal to the Board, on a case-by-case <br /> basis, if they wish to use the inspection report for property transfer. <br /> There were two members of the public present who did not introduce themselves for the record. <br /> One of them inquired about the Solarbees, and Mr. Harrington reported that Conservation and <br /> Natural Resources oversee those, in cooperation with the Tribe. The Board of Health was not <br /> directly involved. <br /> There being no further comments or discussion, Kripani Patel moved to approve the request to <br /> waive the Title V inspection submission fee for Santuit Pond abutters.
