Mr. Harrington stated that there was a set of plans that were reviewed and approved, but those <br /> plans did not include the third hood. The Building and Fire Department had issues because the <br /> existing system did not have the capacity to handle the third hood; therefore, the decision was <br /> made to remove the third hood. <br /> Mr. Harrington clarified that all the Food Code violations were related to the hood. Board <br /> members and the Health Agent discussed the importance of the hood cleaning amongst <br /> themselves and with Mr. Markantonis. Board members then discussed the option of fines, but <br /> were in agreement that it would be reasonable to hold fines since the issue was corrected <br /> promptly; however,they cautioned Mr. Markantonis to avoid future violations. <br /> There being no further comments or discussion, Kripani Patel moved that no fine be issued to <br /> Estia at 26 Steeple Street, provided the establishment complies with all regulations and processes <br /> moving forward. Motion seconded by Kripani Patel. Roll call vote: Ernest Virgilio (yes); Kripani <br /> Patel (yes); Brian Baumgaertel (yes). VOTE: Unanimous (3-0). <br /> 7. Review of Amendments to Short-Term Rental Regulations. Mr. Harrington commented that, in <br /> response to a challenge of the Short-Term Rental Regulation, inspection schedule, and fees by <br /> local timeshares (Sea Mist, South Cape Resort and Cape Holiday Estates), the Town Manager, <br /> Assistant Town Manager, Town Counsel and the Health Agent met with management of the <br /> timeshares and their representative on March 9, 2021 to discuss a possible resolution to their <br /> concerns. Town Counsel supplied the Board with draft amendments of the regulation. <br /> Mr. Harrington reviewed all of the proposed changes with the Board, and commented that the <br /> inspection fees drove the appeal by the timeshares to revise the regulation. The revised <br /> regulation has been vetted by Town Counsel and counsel for the timeshare's, so Board members <br /> had no issues. <br /> There being no further comments or discussion, Kripani Patel moved to approve the Short-Term <br /> Rental and Timeshare Regulation as presented. Motion seconded by Ernest Virgilio. Roll call vote: <br /> Ernest Virgilio (yes); Kripani Patel (yes); Brian Baumgaertel (yes). VOTE: Unanimous (3-0). <br /> At this time, Ernest Virgilio moved to adjourn from Public Session and enter into Executive Session, with <br /> the intention of not returning to Public Session. Motion seconded by Kripani Patel. Roll Call Vote: Brian <br /> Baumgaertel (yes); Ernest Virgilio (yes); Kripani Patel (yes).
