MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION OF SPECIAL PERMIT(SP-2017-35) <br /> Petitioner, The 73 Mercantile Way, LLC, Richard McCracken <br /> 73 Mercantile Way(Map 88 Parcel 94-0) <br /> Mashpee, MA 02649 <br /> SP-2020-05 (MODIFICATION) <br /> Mr. Bonvie wanted to know who will maintain this system. Mr. McCracken said that he is <br /> responsible to make sure the system works,and he is required to maintain the system under <br /> the regulations of the EPA. There is a required maintenance of the system to record and <br /> document who and when uses the system. <br /> There were no more comments from the Board or audience. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> modification to a Special Permit (SP-2017-35). Upon motion duly made and seconded at <br /> the Public Hearings on Wednesday, January 8, 2020 the Zoning Board of Appeals voted <br /> unanimously to issue a modification to the existing Special Permit (SP-2017-35) at 73 <br /> Mercantile Way,LLC to allow for construction of a second boat storage building consisting <br /> of 9,952 sq. ft. at 73 Mercantile Way with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit Modification under Mass General Law 40A Section 9. <br /> 2. Site Plan: 73 Mercantile Way, Prepared for Richard McCracken, Date: November <br /> 21, 2019. Scale: 1"= 30', Sheet 1 of 2, Prepared by: Down Cape Engineering, Inc. <br /> 3. Building Plans: Project: Boat Loft Condominium Mashpee, 73 Mercantile Way, <br /> Mashpee, MA. Dwg. Scale: 1/8" = 1'-0" Sheet No.: A-1: Ground Floor Plan, A-2: <br /> South Elevation,North Elevation, West Elevation and East Elevation. <br /> 4. Conditioned on all Town Department comments read into the record. Specifically <br /> but not limited to a letter from Charles Rowley, Consulting Engineer dated January <br /> 3, 2020 that all the comments contained in this letter are satisfied prior to the <br /> application of a building permit. Also upon completion of the occupancy that <br /> Charles Rowley must sign off that the site is completed to his specifications. <br /> 5.
